June 13, 1977 <br />263 <br />traffic on the street are persons usnig the golf course and this has <br />created a tremendous dist problem Mr. McLean asked Mr. Locher for his <br />thoughts on solving this problem with the participation of the property <br />owners. He asked this be put on the next agenda. Also, Mr. Gotwald to <br />be contacted for cost figures for surfacing that street. <br />Mr. Zelinka felt the County Engineer's office would have those figures. <br />Perhaps he could be contacted. He also felt that any surface put on that <br />street will have to a good one due to the heavy load of traffic. <br />Mr. McLean said there will be another meeting with Mr. Kronholm the first <br />part of July and NSP will be contacted before that meeting. <br />Mr. Schneider questioned the area near the creek that is being used for <br />beer parties, can it be controlled? Mr. McLean suggested dropping a snow <br />fence areound the area. After some discussion, Mr. McLean moved to <br />fence the entrance ti tge area, Seconded by Mr. Zelinka. Motion carried <br />unanimously. <br />Mr. Karth said he would contact Mr. Kronholm for his permission. Chief <br />Myhre suggested putting up 'Private Property' signs. <br />Mr. McLean reported on the trailer parked on a provate lot on Otter Lake. <br />He said this is a 14' camping trailer and show no evidence of persons <br />living in the unit. However, there are no facilities at the site and the <br />wheels have been removed. <br />Mr. Locher pointed out, that according to City Ordinance, it is illegal <br />to remove the wheels of a trailer, even in a trailer park. <br />Mr. MCLean moved to instruct the Building INspector to red -tag the unit <br />and inform the people they have 24 hours to remove the unit. Seconded <br />by Mr. Zelinka. Motion carried unanimously. <br />Mr. Charles Nelson presented a new drawing of Pines Vista II with a <br />change in the configuration of the street and two additional lots in the <br />general plat. Mr. Gotwald had written a letter stating this layout of <br />the street would in no way hinder emergency vehicles. <br />Mr. Curt Feyen, who owns the land to the North of this plat, objected <br />to the word 'road' on the easement along the North edge of the plat. He <br />said he has an easement along that property line for entrance to his <br />peoperty and he felt Mr. Nelson had no right to put another easement <br />overlaid on his easement. <br />Mr. Locher pointed out that his easement is $ot an 'exculsive easement', <br />which means that the under lying property owner may give as many ease- <br />ments over the same land as he wishes. Mr. Feyen asked what the City's <br />plans were for the installation of a street along that easement and was <br />told the City does not install streets, the developers put the streets in. <br />He still objected to the word 'street' and Mr. McLean asked Mr. Nelson <br />if he had any objections to designating this as a 'utility' easement <br />and Mr. Nelson said, No. <br />There was much discussion on this since the street as now shown is one <br />foot inside Mr. Nelson's property. This denies Mr. Feyen the priviledge <br />of using the street for the purpose of obtaining a building permit. <br />It seems there has been negotiations between the two interested parties, <br />with no agreement having been reached.
