13 <br />The Clerk read a notice from the League on a seminar to be held for planning <br />officials. It was turned over to Mr. Cardinal to give to P&Z members. The listed <br />hearing for Acton on the agenda was removed since a letter from Mr. Locher informed <br />that the hearing would be on November 24 after the P&Z hearing on the 19th. <br />Mr. Jaworski moved to grant a bingo permit to the Parents' Club of the Lino Lakes <br />Elementary School for a Turkey Bingo to be held the evening of November 14th. <br />Seconded by Mr. Cardinal. Carried. <br />The Clerk stated that the printed election ballots contained an error in the middle <br />initial of Mr. Bohjanen's name and asked whether Mr. Bohjanen would want the ballots <br />reprinted. Mr. Bohjanen mentioned that the change in initial wouldn't make much <br />difference since people didn't know him by his initial anyway. He asked how much <br />it would cost to have them reprinted. Mr. Locher stated that the error was made <br />by the printer: he would have to replace them at his cost. The Clerk stated that <br />she had sent out one absentee ballot already. Mr. Locher replied that this wouldn't <br />matter. Mr. Bohjanen stated that he wished the ballots to be reprinted. Mr. Locher <br />stated that he would have the new ballots by the next evening. <br />Mrs. Blaylock had requested the use of the Hall on February 24 for the GOP caucus. <br />The Clerk was instructed to put it on the calendar. The Clerk showed a copy of the <br />Fire Prevention Code which had been received from Lexington and also copies of <br />the St. Paul Plumbing and Electrical Codes, which were turned over to Mr. Cardinal <br />for the P&Z. The Clerk stated that Mr. Jack DeVine had contacted her prior to the <br />meeting and showed her the trailer permit he had just taken out from Mr. Dupre <br />persuant to Mr. Locher's letter of October 24th. <br />The hearing for Mr. Stein on the question of rezoning and a special use permit for <br />the proposed trailer park off Elm Street was called to order at 8:37 p.m. The <br />Attorney stated that all affidavits were complete and in order: he had inspected <br />them at the P&Z meeting. Neither Mr. Stein nor his representative, Crystal Ahlman, <br />were present. Mr. L'Allier asked for any comments in favor of the trailer park. <br />There were none; however, a letter to Mr. Locher by Mrs. Johanna Husnik in favor <br />of the park was read. The letter was given to the Clerk to file. There was dis- <br />cussion on what the layout of the park was to be, that a model of the proposed park <br />had been at the Hall for some time, lack of sewer facilities. Mr. Bohjanen pointed <br />out that the park would have to adhere to our strict ordinance and requirements. <br />There seemed to be considerable opposition to the park, particularly on the questions <br />of taxes and sewers. Mr. Bob Raymond presented a petition against the proposed <br />park with 164 signatures, these including 10 signatures of property owners within <br />300 feet of the park. The Council accepted the petition on a motion by Mr. Jaworski, <br />seconded by Mr. Rosengren, which carried unanimously. There was mention of Mr. <br />Stein's plans to build sewer lines to sewer district specifications, the oversizing <br />that would be needed for other property owners to hook up and the fact that NSSSD <br />will not contract with a private individual. Mr. Jaworski stated that he had <br />looked at the site and felt that the land was too good for a trailer park and <br />should be used for a residential development. <br />Mr. Sutliff asked whether property owners could refuse to let the sewer lines cross <br />their property. Mr. Locher answered that, if they had a franchise from theVillage, <br />they could be delegated the power to condemn property; if they were considered a <br />private utility company, since a private individual cannot do so. Minnesota law <br />also gives a person "just compensation" for such condemnation; this can be arbitrated <br />and appeals made. Mr. Locher stated that benefitted property owners would pay a <br />special assessment; however, if they cannot use the facility they do not pay. If, <br />however they can use it in the future then they pay for the trunk line. There was <br />debate on the assessment for sewer on a corner lot in the Lakeview area. <br />
