54
use permit as well as an extension of his 90 -day permit. Mr. L'Allier asked
whether Mr. Dahl had given any date when he would remove the trailer and was told
no, but that the lease ran until June 1, 1970. Mr. Locher noted that there was a
serious question about the possibility of the trailer having been considered to be
rented unless it was shown that the rent was on an overall basis. There was no
prohibition of leaving the trailer if it was not used for residential purposes.
Mr. Cardinal moved that a letter be sent to W. Dahl stating that the trailer be
moved off the property by June 1 when the current lease expires, and that W. Dahl be
allowed to leave a light burning. Also that the police check periodically after
Jan. 13 (when the 90 -day permit is up) to see that no one is living in the trailer.
Seconded by W. Jaworski. Carried. The hearing was closed at 9:31 p.m. Mr.
L'Allier thought that the ordinance should be changed so that no trailers other
than camping trailers could be stored in the Village.
At 9:32 the hearing for Mr. Joseph Schmitz was called to order. Mr. Locher read
the affidavits for the posting and the mailing of notices for the special use
permit. Mr. Schmitz was not in the audience; his promised check for $100.00 had
not arrived. Mr. Locher stated that he had the certified copy of the deed for
Mr. Schmitz' property and that it showed no easement for a roadway. Mr. Schmitz
had promised to have an abstract of a 15' easement at the hearing. W. Locher
stated that at the time of the rezoning for the trailer park, he had mentioned
this lack of easement to Mr. Schmitz.
There was no comment pro or con from the audience. W. Cardinal stated that the
P&Z had recommended that the Council deny a special use permit for a trailer to
Mr. Schmitz. Mr. Cardinal stated that he felt the same since Mr. Schmitz did not
apply for a temporary permit when he had been told to at the Council meeting and
had moved in without contacting anyone to see what the laws were; also there were
trailer parks open.
Mr. Cardinal moved that the Council on the P&Z recommendation deny a special use
permit to W. Schmitz and that a letter be written to him stating that the trailer
be removed within 30 days. Seconded by Mr. Rosengren. Carried. The hearing closed
at 9:38 p.m.
W. Cardinal stated that the P&Z had considered again the request by Naegele Sign
Company to erect 3 signs for Chomonix and had recommended the special use permit
be granted provided that the application forms and copy of the lease be provided.
No one was present from Naegele. Mr. Cardinal moved that a special use permit
be granted to Naegele Sign Company to erect three signs for Chomonix at Birch
Street opposite Seventh Avenue, at the intersection of Birch Street and Hodgson
Road and at the intersection of Hodgson Road and Old Hwy. 8 by the Apple Inn
providing that the above mentioned forms be provided. Seconded by Mr. Rosengren.
Carried.
Mr. Cardinal mentioned that the amendment to Ordinance 6 was not in effect. Mr.
Locher stated that all amendments to Ordinance No. 6 required 2 weeks of published
notice and posting. Mr. Cardinal moved that the proposed amendment No. 6Q be
published so that it could be acted upon at the next meeting. Seconded by Mr.
Bohjanen. Carried.
W. Gilbert Menkveld came forward to provide legal descriptions and a map showing
the locations of the 3 parcels of land he owns in Lino Lakes where he wished to
put up trailer courts as he had requested at the P&Z meeting. It was noted that
