218 <br />10/26/70 <br />Mr. Locher stated that officials are reimbursed for out -of- pocket expenses only. <br />This is an expense to the Village,but these people can't be expected to lose <br />money from their jobs. Mr. L'Allier noted that some people can't take time <br />off from their jobs for such things without loss of pay; this was the case with <br />Mr. Jaworski. Mr. Bohjanen commented that he doesn't know when the notice of <br />the nearing arrived, but if he had received it sooner, he could have gone with <br />no expense to the Village. Mr. Locher stated that the Village was named in <br />the action, not the Mayor and Council. <br />Mr. Menkveld stated that the action was brought to stop the vote and that if it <br />had been up to him, he wouldn't have defended, but would have lost by default. <br />He didn't feel that the Village should have expended money on this defense; if <br />we had not appeared it would not have cost anything. W. L'Allier asked Mr. <br />Menkveld if he thought that the Village would ignore the injunction- -that he <br />relied on no action? Mr. Locher stated that if Mr. Menkveld's theory held true, <br />then any action against the Village should go by default. <br />Crystal Ahlman stated that Peter Scherer stated that he would pay all costs. <br />Also, that $45.00 was a lot of pay for one day's work for a truck driver. Mr. <br />Jaworski commented that his time slip was on file if she wished to check the <br />amount. Mr. Locher stated that the Village has nothing to hide. <br />Mr. Cardinal moved to send a breakdown of the defense costs to Mr. Summers as <br />requested. Seconded by Mr. Bohjanen. Carried unanimously. <br />The Clerk inquired whether the Council wished at this time to send a moving <br />notice to Mr. Breasted, owner of the building. Mr. Locher noted that such a <br />notice would have to be mailed by midnight Saturday if it was to be effective <br />for November 30th. Mr. Rosengren stated that the construction of the new <br />building looks good; that the only delay might be in the floor covering. Mr. <br />Backlin doubted that Mattson would be through by December 1st; although the <br />outside is pretty well completed, there is lots of work on the inside. <br />Mr. Bohjanen moved to send a letter to the building owner stating that this <br />building will be vacated by December 1, with a copy to be sent to Mattson <br />Building & Supply Co. Also, that a letter be sent to Mattson stating that we <br />are making the move and tilt we expect the building to be ready by that time. <br />Also, that we request Mattson to complete the office portion first and do the <br />rest later. Seconded by W. Cardinal. Carried unanimously. <br />Mr. Rosengren moved to authorize Northwestern Bell Telephone Co. to install a <br />25 pair cable for service to the new building. Seconded by Mr. Cardinal. <br />Carried unanimously. <br />Mr. Cardinal reported on the Planning & Zoning meeting held on October 21. <br />Elsworth and Ken Rehbein had presented plans for apartment buildings, and <br />recommendations from the Engineer and the Planner had been read. There were <br />some corrections to be made before the hearings. Mr. Cardinal moved to set <br />hearings for rezoning for El Rehbein & Son before the Planning & Zoning on <br />November 18th and before the Council on November 23rd, both at 8:30 p.m. <br />Seconded by Mr. Rosengren.
