12 '1 <br />Mr. Cardinal moved to approve and accept the final plat for Lakes Addition <br />Number One with the following stipulations: 1) that the easements for util- <br />ities be shown on the hardshell map; 2) that a street bond in the amount of <br />$98,751.00 be posted with the Clerk and 3) that the 10% park dedication be <br />added into the future park area of the development. Seconded by Mr. Jaworski <br />Carried unanimously. <br />Mr. Jaworski then moved that Lino Lakes adopt a resolution accepting 10% or <br />3 acres of the land area of Lakes Addition Number One for park area; this <br />amount will be adjusted if the land area goes over 30 acres. Seconded by <br />Mr. Rosengren. Carried unanimously. <br />The Council then discussed building permits with the representatives. Mr. <br />Dielentheis agreed to abide by the Minnesota Plumbing Code and will wait for <br />a Village inspector since the models wouldn't be very far along in 30 days. <br />The models for which he wants building permits include ose townhouse consisting <br />of four units and also four homes. The only basement would be under the town- <br />house as it is on high ground. The definite property lines of the townhouse units <br />will be made later before the units are offered for sale and will follow the <br />walls. The plat does not need to be filed as long as there are no houses for sale. <br />Mr. Jaworski then moved that there was no reason not to issue building permits <br />on the townhouses and the four model homes as long as U. S. Lakes Development <br />Company complies with the following stipulations: 1) the bond for street <br />building is presented to the Clerk; 2) the Engineer approves the placement <br />of utilities; 3) the observance of the regulations of the Minnesota Plumbing <br />Code and inspection by a Village Inspector and the payment of the necessary <br />inspection fees, although; the code is not yet in effect; and 4) assuming no <br />unforseen circumstances the completion of all streets in Lakes Addition Number <br />One by the end of the 1970 construction season. (November). The Building Inspector <br />will enforce the soil compaction under our ordinance. Seconded by Mr. Cardinal. <br />Carried. <br />Mr. Bohjanen moved to authorize the Mayor and the Clerk to sign the final plat <br />copies after the stipulations are met. Seconded by Mr. Jaworski. Carried unan. <br />The hearing closed at 9:27 p.m. <br />Mr. Ken Rehbein requested three variances to straighten boundary lines on the <br />former Ernest Ludwig property and neighboring property. Mr. Locher questioned <br />the legal description on a 2' wide stretch, calling it a floating line, but <br />adding that it was up to the owner to straighten this out and was not the <br />Villages responsibility. Mr. Cardinal moved to grant variances to Ken Rehbein <br />on the following pieces of property legally described as follows: <br />PARCEL 1. That part of Lot 10, Auditor's Sub. No. 151, Anoka County <br />Minnesota described as follows: Beginning at the northeasterly corner <br />of said Lot 10; thence southerly on the easterly line of said Lot 10, <br />a distance of 10 feet, thence northwesterly to the northwesterly corner <br />of said Lot 10; thence easterly to the point of beginning. <br />PARCEL 2. The northerly 218 feet of the westerly 14 feet of Government <br />Lot No. 3 section Twenty (20), Township Thirty -one (31), Range Twenty - <br />two (22), Anoka County, Minnesota. <br />PARCEL 3. The northerly 2 feet of that part of Lot 27, Auditor's Sub. <br />No. 151, Anoka County, Minnesota, lying easterly of the tract of land <br />owned by Arther Rehbein and described in Book 682, Page 353, and filed <br />in the office of the Register of Deeds in and for said county. <br />Seconded by Mr. Rosengren. Carried unanimously. <br />
