19 <br />The minutes of the Planning and Zoning Board for June 18 were read. <br />The hearing for rezoning and a special use permit for Mr. George Smith tooperate <br />a riding stable on property on Birch Street was called to order at 8:29 p.m. <br />Affidavits of publishing, posting and mailing were deemed to be in order, although <br />Mr. Locher mentioned that School Dist. #12 had received a late notice due to an <br />oversight and that the notice sent to Mr. Emmett Leibel had been returned by the <br />Post Office. Mr. Locher stated that IAI Corp. represented by Mr. John B. Phaff, <br />does not wish to rezone the parcel to commercial, but only wished a special use <br />permit to be issued. Mr. Locher then suggested that the Village adopt an ordiance <br />change to Ord. 6 which would permit the creating of limited commercial areas. He <br />then read his proposed changes to Sect. 3 of Ord. 6 which basically states that <br />areas may be created for only one type of commercial usageand the Council could <br />rezone this property back to residential if it wished. This would permit a more <br />orderly plan of organization as a person couldn't add any other commercial oper- <br />ation without coming to the Council for approval. Mr. Locher noted that there was <br />a reference in Ord. 6 to a limited commercial district, but there were none existing. <br />This proposed amendment, Ord. No. 6 -0 would have to be published, and the Smith <br />hearing continued to a later date. However, Mr. Locher thought that the Council <br />should give Mr. Smith some indication of their intent on the special use permit. <br />After some discussion, Mr. Rosengren moved to adjourn the hearing, to be reconvened <br />at a later date with proper notification. Seconded by Mr. Cardinal. Carried. <br />Mr. Bohjanen then moved that proposed Ordinance No. 6 -0 be studied and read at <br />the next meeting, to be adopted then or later. Seconded by Mr. Rosengren. <br />Carried. The Clerk will make copies of the proposed amendment to be sent to the <br />Council members. <br />After discussion, Mr. Bohjanen moved that Mr. Geroge Smith be temporarily per- <br />mitted to operate a riding stable, starting immediately, until the reconvening of <br />the hearing on July 28th, and that such permission shall not jeopardize the <br />Council's decision on a special use permit. Seconded by Mr. Cardinal. Carried. <br />It was decided that a letter from the Clerk would be sufficient as a temporary <br />permit for Mr. Smith. <br />Mr. Smith was asked about insurance on his operation and replied that he was <br />bonded and that the place was posted with signs reading "ride at your own risk" <br />as the premiums on horse insurance were much too high. Any more discussion will <br />be taken up on July .:,28th. <br />Mr. Alfred Maisio requested permission to create 2 lots out of 3 lots in Nordin <br />Manor on 132nd Avenue. After discussion, gr.` Cardinal moved to grant a variance <br />to Mr. Maisio to divide the lots as requested, but reminding Mr. Maisio that the <br />Village was under no obligation to improve the street as it has never been accepted <br />by the Village (although dedicated), that there was only an agreement for partial <br />maintenance on the street, htat 132nd Avenue (Maple Street) is actaully a Vil- <br />lage street but not accepted for full maintenance and that a building permit could <br />be issued therefore, however, this would not be the case if the road were only <br />an easement. The lots created are described as follows: <br />Lot 1. All of Lot 18 and the West 26 feet of Lot 19, Block 2, Nordin Manor. <br />Lot 2: All of Lot 20 and the East 50 feet of Lot 19, Block 2, Nordin Manor. <br />Seconded by Mr. Jaworski. Carried unanimously. <br />Mr. Cardinal reported that he had received a request for a split entry house to <br />be built on Lot 2, Blcok 1, Blomquist Addition, which would leave side widths <br />on the lot of only 7 and 8 feet. The lot in question was only 75' in width/ the <br />owner also owns the adjoining 100' lot. There was much discussion on possibly <br />
