217 <br />Mr. Cardinal also reported that Mr. Bruce Kafke, 6250 'dare Rd., had requested <br />permission to put a mobile home on his father's place (which he is buying) since <br />his father is in poor health and he wishes to have him close by to take care of him. <br />The PO had recommended allowing the trailer on a hardship basis. A motion was made <br />to allow the trailer, but Mr. Locher reminded that a hearing was necessary since <br />a special use permit would have to be granted. Mr. Cardinal moved that one 90 -day <br />permit be granted to Mr. Kafke while we proceed with notification and hearings on <br />the special use permit. Seconded by Mr. Jaworski. Carried. It was specified that <br />the trailer would have to meet the 10' by 45' minimum size. The hearing was set <br />for August 20th and August 25th. The clerk was instructed to call Mr. Kafka for the <br />legal description. <br />At 9:30 p.m. the hearing on the Jandric franchises was called to order. Mr. L'Allier <br />stated that the Council had met with the fiscal agent, Mr. Springsted, that they had <br />received cost estimates from the Engineers, but that they had not yet acted on the <br />franchises. <br />Mr. Busch took the floor to again request that the Council allow the franchises <br />immediately as the Company was putting off work on the new project until they find <br />out which type of sewer and water systems they will have. They also need the Council's <br />decision before they can sell the homesites. <br />Mr. Busch noted that the project would be of benefit to the entire Metro area; also <br />they had received written approval from the PCA. Because of the restrictions set <br />by the PCA on the sewage plant, Jandric had to switch their primary area to the east <br />side of Reshanau Lake in order to have the proper level over the water table for the <br />ponding area. <br />The Clerk read the letter from PCA giving the following recommendations: <br />1. The general proposal which provides for secondary treatment by the activated <br />sludge process (extended seration) with the treated effluent being discharged to an <br />absorption pond with no discharge to surface waters appears to conform with this <br />Agency's requirements. <br />2. The bottom elevation of the effluent pond should be at least four feet above <br />the water table. <br />3. Chlorination facilities should be provided. <br />4. Since carry -over of sludge solids in the effluent may have a detrimental <br />effect on the absorption pond, we recommend that a sludge holding tank be provided. <br />5. A distance of at least 300 feet is recommended for location of the treatment <br />works from residences or occupied dwellings. <br />6. While this disposal system (secondary treatment and absorption pond) has <br />been used previously in Minnesota, there is no system as large as proposed (185,000 <br />GPD at design) in operation presently in Minnesota. However, on a temporary basis <br />(not more than five years) until municipal sanitary sewer service can be provided, <br />we would be willing to favorably recommend this system for Agency approval upon <br />concurrence in this matter from the Metropolitan Council. <br />7. The application for a waste disposal permit should be made jointly by the <br />company and the village, or a copy of an agreement with the Village Council should <br />be furnished indicating that the village will assume full responsibility for the <br />maintenance and operation of the sewage collection and treatment system in the event <br />of default by the company. <br />8. Adequate construction plans should be furnished for review at the same time <br />application is made for a permit. <br />Also, the letter from Drover's State Bank was read, stating in essence, that mortgage <br />financing for Chomoniz Utilities Co. cannot be secured unless they had unencumbered <br />title to the properties involved and that there would be no possibility of obtaining <br />financing if the franchise required that it conveytitle to the community for less than <br />the fair value thereof at the time of the completion of the systems or later during <br />the economic life expectancy of the property. <br />
