262 <br />Whereas improvements to the drainageway are necessary to prevent damage <br />to property located downstream even with existing flows; and, <br />Whereas the drainage area of the Rice Creek watershed is within four <br />counties and about 35 local units of government; and, <br />WW#01/0 #44 /Wf W0t/ #/ X00 /XWO / M*a' `a5� /a /XX#/ga f <br />Whereas, the Minnesota Statutes, Chapter 112, outlines the powers, duties, <br />functions, purposes, and method of establishment of a Watershed District; but, <br />Whereas, the provisions of the Statutes relating to composition of the Board <br />and tbod efoselhet :gn,ofethel.membdrs (112.37, 112.42) appear to be difficult <br />to implement in an area with as many governmental subdivisions as the Rice <br />Creek watershed area; and, <br />Whereas, the provisions of the Statutes relating to assessments, levies, <br />and finances of the District (112.60 - 112.64) appear to have been designed <br />primarily for use in an agricultural situation: <br />Now, Therefore, Be It Resolved by the Village Council of the Village of <br />Lino Lakes that there should be created a watershed board to improve <br />and manage the channel and flow of the Rice Creek for the benefit of all <br />the lands lying within the drainage area; and, <br />Be It Further Resolved that such a board should be created by special <br />legislation of the Legislature of the State of Minnesota after due study <br />and consideration of the problems already mentioned as well as the problem <br />of the diversity of interest that already exists in the watershed area. <br />Seconded by Mr. L'Allier. Motion carried. <br />Mr. Rosengren reported that a minimum amount of work was being done on the roads such as <br />sanding and that the plows were ready to operate when needed. <br />Mr. Rosengren reported that the Village employee, who alledgedly was supposed to have <br />been seen coming out of the Centerville Corner Bar and get into the Village pickup <br />was not in the Village that evening and had not operated the truck that day at all, <br />Mr. Bohjanen made a motion that the report as explained by the Councilman in charge of <br />roads be accepted by the Council. Seconded by Mr. Cardinal. Motion carried. <br />Mr. Backlin stated from the floor he was not in the Village when this incident was to <br />have taken place and requested from the attorney what action might the Village take <br />against such charges. Mr. Locher stated that the Village could do nothing as this was <br />a private matter. <br />Mr. Bohjanen made a motion that in the future if any charges are made against any <br />employees that they first be turned over to the Personnel Commission. Seconded by <br />Mr. L'Allier. Motion carried. <br />P & Z minutes were read. <br />Mr. Lawrence Regnier asked that he be allowed to add 16 feet of land to his 84 foot <br />lot so he might be able to drive to the rear of his lot past his garage. Mr. Locher <br />stated a variance would have to be issued. Mr. Cardinal made a motion that a variance <br />be granted to Mr. Regnier on the following lot: South 16 feet of the North 100 feet <br />of Lot 7, Block 6, Lexington Park Lake View subject to 5 foot easement across the rear <br />lot line therof; and that the attorney has advised the Council that there should be <br />
