Water service is not available at this time. <br />Staff is recommending that all lots be served with sanitary sewer <br />and that the owner sign an agreement not to object to water service <br />when it becomes available. It is also recommended that Mr. MacNeil <br />provide a 10 foot utility /drainage easement on the side and rear <br />property lines. <br />The lot width and area requirements would be met in this proposed <br />subdivision but lot depth would be deficient and require a variance <br />of 10 feet in depth for each lot. The findings of fact for the <br />variances are: <br />1. The most reasonable use of this property would be served by <br />allowing the variance for 10 feet in lot depth. <br />2. The property in question is unique as it is a corner lot of <br />record, 125.94 feet by 299.3 feet. <br />3. The hardship in this case is not economic in that the creation <br />of three building sites is the most reasonable use of the <br />property. <br />4. No special privilege will be conferred on the applicant by <br />granting this variance and the property immediately to the <br />east has previously been divided in the same manner. <br />5. The proposed request will not unreasonably diminish or impair <br />established property vales within the neighborhood and may, in <br />fact, enhance the area by eliminating a vacant parcel of <br />property <br />6. The proposed action will be in keeping with the intent and <br />spirit of the ordinance by allowing the maximum use of the <br />property. <br />The Planning and Zoning Board has recommended approval of the <br />request with the following conditions: <br />a. A survey be provided indicating exact dimensions of lots. <br />b. An agreement be signed by the property owner indicating no <br />objections to the extension of water service when and if it <br />becomes available. <br />c. The newly created lots be provided with sewer service as <br />recommended by the City Engineer. <br />PAGE 4 <br />203 <br />
