He noted that he and a number of other residents
had altered their schedules so that they could attend this
meeting. Mr. Smith asked what valid reason was given for the
last minute cancellation. It was noted that a letter was
received late last week from the homeowners attorney asking for
the delay. However, the agenda had already been prepared and
staff did not have the authority to delete the item.
Ms. Kerry Ostergren, 6900 Black Duck Drive explained that the
homeowners concerns were prepared and sent to Mr. Hawkins last
Wednesday morning. However, Mr. Hawkins did not have time to
respond to the concerns until Friday and that did not leave
enough time for the homeowners to consider his response.
Mr. Hawkins explained that he did talk to the homeowners attorney
and told him that he would have an opinion prepared for this
meeting tonight. The item did not have to be delayed because of
Mr. Hawkins review but was delayed because of a family matter.
Mr. Donald Dunn, 6885 Black Duck Drive said he did not understand
the delay. He asked if this item would automatically appear on
the next agenda? He was told yes.
Mr. Paul Brand, 6789 East Shadow Lake Drive asked if Mr. Hawkins
would give his report at this time. Mr. Schumacher explained it
would be appropriate to have something from Mr. Hawkins in
writing. Mr. Hawkins said that when he heard the item was to be
delayed he did not complete all the necessary findings. He is
planning to meet with the Planning Administrator before he
finalizes his opinion.
Mr. Brand explained that this matter has been addressed a number
of times since the subdivision of Reshanau Park Estates was first
presented. He and a number of his neighbors are trying to be
friendly however, he felt the continued effort by the homeowners
association was causing a rift.
Mr. Peter Brown, 6897 Black Duck Drive said that the handling of
this matter gives residents little faith in government. He noted
that a boat launch was "shot down" three (3) years ago. Most
recently, when the matter was before the Planning and Zoning
Board and it appeared that it would be "shot down" again, the
PAGE 2
221
