The PUD would function as a development procedure <br />whereby a mixing of buildings and/or uses can occur which cannot <br />otherwise be addressed by the base zoning district, or whereby <br />internal site design standards deviates from the Ordinance may be <br />allowed to improve site design and operation. The City's Planned <br />District Overlay (PDO) zoning designation functions solely as an <br />overlay district and can only be implemented when the proposed <br />use is a permitted use or a conditional use as identified in the <br />base zoning <br />Council Member Bergeson asked if the PUD zoning district would <br />replace the PDO zoning district. He said he is not comfortable <br />about this if it is to replace the PDO zoning district because <br />the City Council had been urged to eliminate PUD zoning within <br />the last year or so. Council Member Bergeson asked if this PUD <br />zoning ordinance was similar to the PUD ordinance previously in <br />place. He asked that a side by side comparison be made. <br />Council Member Bergeson moved to table the second reading of <br />Ordinance No. 93 - 08 until June 28, 1993 and to bring the matter <br />to the June 23, 1993 Council Work Session. Council Member <br />Elliott seconded the motion. <br />ATTORNEY'S REPORT <br />Consideration of Accepting Warranty Deeds for Apollo Drive; <br />Donald and Marlys M. Cisewski, Thomas C. and Charlene Berglund, <br />Peter P. and Nancy L. Wolfbauer, Robert Edward and Penny Linda <br />Ring - Mr. Hawkins explained that settlements have been <br />negotiated for portions of the new Apollo Drive roadway. There <br />are ongoing negotiations with the remaining landowners and the <br />eminent domain process is continuing for those who will not <br />accept the proposed settlements. Mr. Hawkins asked that the City <br />Council accept the warrantee deeds for the above listed <br />landowners. He also noted that the next Disbursement Listing <br />will contain the negotiated cost for these parcels and the City <br />Council will be asked to approve those expenditures. <br />Council Member Kuether moved to accept the warranty deeds for <br />Donald and Marlys M. Cisewski, Thomas C. and Charlene Berglund, <br />Peter P. and Nancy L. Wolfbauer, Robert Edward and Penny Linda <br />King. Council Member Elliott seconded the motion. Motion <br />carried unanimously. <br />CONSIDERATION OF RESOLUTION NO. 26 - 93 ACCEPTING DONATION FROM <br />THE CIRCLE -LER VFW POST 6583 <br />Mr. Schumacher explained that the City Council has adopted a <br />policy requiring all donations be approved by the City Council. <br />PAGE 3 <br />201 <br />
