1 <br />1 <br />1 <br />COUNCIL MEETING NOVEMBER 22, 1993 <br />the next six (6) to eight (8) weeks. <br />Robert Bening, 6788 East Shadow Lake Drive asked about the trail <br />system for bikers and walkers. Mr. Hanson pointed out the <br />location of the trail system and noted that there is no other <br />place to construct the trail system due to the wetlands <br />restrictions. <br />Council Member Bergeson asked if closing the public hearing at <br />this time mean that the project could not be modified. Mr. <br />Hawkins said no. <br />Council Member Elliott moved to close the public hearing at 8:07 <br />P.M. Council Member Neal seconded the motion. Motion carried <br />unanimously. <br />The City Council must follow the City Charter and wait 60 days <br />before ordering the public hearing. <br />CONSIDERATION OF RESOLUTION NO. 91 - 93 ORDERING PREPARATION OF <br />PLANS AND SPECIFICATIONS FOR THE LAKE DRIVE (COUNTY ROAD #23) AND <br />HIGHWAY #49 INTERSECTION IMPROVEMENT <br />Mr. Schneider explained that SEH has suspended all work on this <br />project. The feasibility report recommended initiating plan <br />preparation by October 25, 1993. Since it is important to keep <br />as close to the schedule as possible if the improvements are to <br />be considered for funding by MnDOT in their fiscal year 1995 <br />(July 1, 1994). Mr. Schneider recommended that plans and <br />specifications be ordered at this time. He noted that MnDOT's <br />encumbrance of funds is finalized upon their approval of <br />construction plans so that the later the plans are submitted, the <br />lower the chances are that funding will be available for fiscal <br />year 1995. <br />Mr. Schneider also noted that plan preparation is dependent upon <br />permit requirements, particularly the mitigation of impacted <br />wetlands, and the identification of wetland impacts is a function <br />of the design process. This coordination between plan <br />preparation and permitting is becoming considerably more time <br />consuming and is one of the factors considered in the project <br />schedule. <br />The estimated project expenditures to prepare plans and <br />specifications as indicated in the feasibility report is <br />$94,000.00 through February, 1994. <br />Council Member Bergeson asked what happens if the City spends the <br />dollars for plan preparation, orders the project and the owner of <br />PAGE 9 <br />31 <br />
