346 <br />COUNCIL MEETING DECEMBER 13, 1993 <br />Ms. Wyland explained that a request for an Interim Permit would <br />come before the City Council for their consideration and <br />approval. Council Member Bergeson asked that the actual permit <br />be designed so that the applicant signs a statement stating that <br />they understand the provisions of the permit. <br />Council Member Elliott moved to approve the FIRST READING of <br />Ordinance No. 93 - 23 and dispense with the reading. Council <br />Member Neal seconded the motion. Motion carried unanimously. <br />'•ENGINEER'S REPORT, DARRELL SCHNEIDER <br />Consideration of Resolution No. 98 - 93 Adopting the Permanent <br />Rules of the Wetland Conservation Act - The Minnesota Wetlands <br />Conservation Act (WCA) of 1991 went into effect on January 1, <br />1992. The WCA calls for a Local Government Unit (LGU) to take <br />responsibility for administering the WCA throughout the State. <br />The Rice Creek Watershed District (RCWD) declared itself the LGU <br />for administering the temporary rules for the WCA beginning on <br />January 1, 1992. At that time the City of Lino Lakes could not <br />qualify as the LGU because the City had not yet completed <br />substantial work on a Local (Surface) Water Management Plan. <br />The permanent rules for the administration of the WCA go into <br />effect on January 1, 1994. Municipalities that qualify are <br />encouraged by the Board of Water and Soil Resources (BWSR) to <br />pass a resolution indicating their support for the permanent <br />rules of the WCA and their intention to assume responsibility as <br />the LGU when they properly qualify. Resolution No. 98 - 93 <br />establishes Lino Lakes as the LGU with the interim administration <br />to be maintained by the RCWD and the Vadnais Lake Area Water <br />Management Organization (VLAWMO) until approximately April 1, <br />1994 when Lino Lakes is expected to have completed the Local <br />(Surface) Water Management Plan. <br />Council Member Kuether moved to adopt Resolution No. 98 - 93. <br />Council Member Elliott seconded the motion. Motion carried <br />unanimously.
