1 <br />1 <br />1 <br />COUNCIL MEETING DECEMBER 13, 1993 <br />allowed additional privileges. This district was created to <br />provide for the transition from rural to business use. Normally <br />a Conditional Use Permit (CUP) is allowed for additional <br />privileges. However, a CUP remains with the land and has no <br />ending date similar to a rezone. <br />Council Member Kuether asked what would have to happen to end a <br />particular home occupation. Ms. Wyland explained that a <br />particular event, such as rezoning bordering property, not <br />necessarily a specific date would cause staff to start action to <br />cancel the permit. Council Member Kuether explained it seemed <br />unfair to allow the establishment of a home occupation and then <br />down the road, withdraw the approval. <br />Council Member Bergeson asked what would prevent a landowner in <br />an area zoned Rural but located in a different part of the City <br />from coming and asking for an extended home occupation use. Ms. <br />Wyland explained that the proposed ordinances are drafted for <br />this particular area only. There are no other areas in Lino <br />Lakes zoned R -BR. Council Member Bergeson said it was his <br />understanding that the R -BR District was established to reserve <br />land for business use, not to promote home businesses. Ms. <br />Wyland explained that the provision was that only existing farm <br />buildings can be used for the home occupation and will limit the <br />home business to just a temporary situation. <br />Council Member Kuether said she still was uncomfortable about <br />this matter because there appears to be no specific end of the <br />home occupation. Ms. Wyland noted that the original ordinance <br />establishing the R -BR District contained a formula for adding <br />land to the R -BR District. The rezoning of a neighboring parcel <br />of land would indicate the end of a home occupation. Council <br />Member Kuether suggested that an interim use permit could be <br />approved and when development progresses to a certain point the <br />interim use must stop. Ms. Wyland explained that this is all <br />addressed in the proposed ordinances. <br />Mayor Reinert said the proposed ordinances are fair and all <br />potential landowners in the R -BR Zoning District should <br />understand all of the requirements. <br />Mr. Schneider read Subd. 36, Interim Uses, paragraph (4) <br />TERMINATION which outlines when a interim use would be <br />terminated. <br />Council Member Elliott said she felt that these two (2) proposed <br />ordinances would be good transitional tools and provide for a <br />logical progression to business use of the properties. <br />PAGE 9 <br />345 <br />
