1 <br />1 <br />COUNCIL WORK SESSION JUNE 8, 1994 <br />most efficient way to get to the park. The trail would continue <br />through the cul-de-sac to a ditch. The City would have to build <br />the remaining trail since it is beyond the boundary of Trapper's <br />Crossing. Mr. Asleson also explained that the City would have to <br />purchase the parcel of land beyond the ditch. This parcel of <br />land would be used to enlarge Birch Park. He noted that the <br />owner of the parcel is willing to sell it to the City. An <br />appraisal was completed three (3) years ago for another 1.5 acre <br />parcel in this same area. That parcel was acquired by the City. <br />The appraisal at that time was $5,500.00 per acre. Money for <br />acquisition of this parcel would come from the Dedicated Park <br />Fund. <br />Mr. Asleson explained that the RCWD has been involved and Ms. <br />Kate Drury will walk the area to determine the shortest place to <br />cross the ditch. <br />Council Member Bergeson expressed concern and said he did not <br />want another "Shores of Marshan" problem where a trail is almost <br />touching two (2) garages. He asked that Mr. Asleson work with <br />the developer to keep trails away from buildings. Council Member <br />Kuether suggested that an ordinance be adopted that would dictate <br />where trails can be located. <br />Mayor Reinert noted that some trails in the Reshanau Park Estates <br />area are very close to houses. He asked if Council Member <br />Kuether was suggesting that the ordinance be amended to <br />incorporate setbacks from trails? Mr. Schneider explained that <br />the Shores of Marshan Lake subdivision was the last subdivision <br />where trails are located on easements rather than dedicated <br />trailways. He cautioned that requiring additional setbacks for <br />trails means less lots in any particular subdivision. Fewer lots <br />means the feasibility of utility extensions is a real problem. <br />Council Member Kuether said she would rather approve a variance <br />on a lot with a trail easement. Mr. Schneider suggested rather <br />than give variances, rezone the plat a Planned Unit Development <br />(PDO) . <br />Mr. Asleson explained that most problems occur when trails cross <br />lots on a cul-de-sac. Because the frontage is already less than <br />normal, trails get very close to buildings. <br />Council Member Bergeson felt that staff should closely review <br />lots with trail easements on them. Mr. Schumacher said the Park <br />Board and the Planning and Zoning Board should also give these <br />lots additional consideration. <br />Council Member Neal noted that during the cable cast of the Park <br />Board, the sound was not working.
