COUNCIL MINUTES July 8,1996 <br />• CONSIDERATION OF FIRST READING, ORDINANCE NO. 08 - 96, AMENDING THE <br />ORDINANCE ON MANDATORY SEPTIC PUMPING, PETER KLUEGEL <br />Mr. Kluegel explained that the Minnesota Pollution Control Agency is requiring that all on-site <br />sewage disposal systems be inspected biennially except for those systems that are up to code and <br />have less that 50% of the allowable sludge and scum after re -inspection. These property owners <br />may request a triennial inspection of their systems. <br />Each property owner will receive an inspection report form from the City and will then have their <br />septic system pumped and inspected. The inspection will include the examination of the <br />drainfield area for evidence of system failure. Failure by the property owner to complete the form <br />and return it to the City will be cause for the City to have the septic system pumped and <br />inspected. The City will contract to have the work done and assess all costs to the property. <br />Mr. Kluegel explained that mail the report forms and require that they be completed and returned <br />to the City no later than September 1 of the same year. <br />Council Member Bergeson moved to approve the first reading of Ordinance No. 08 - 96, as <br />presented. Council Member Lyden seconded the motion. Motion carried unanimously. <br />PLANNING AND ZONING BOARD REPORT, MARY KAY WYLAND <br />Consideration of Rezone, PDO, and Preliminary Plat, Sea Plane Base, Bruce Hanson - Ms. <br />Wyland explained that the Planning and Zoning Board recommended approval of the rezoning, <br />preliminary plat, and PDO at their June 12, 1996 meeting with the conditions outlined in the staff <br />report. The Planning and Zoning Board also discussed this item at their May, 1996, meeting in a <br />concept form and indicated at that time that they concurred with the concept. Mr. Hanson then <br />proceeded with his application. <br />Ms. Wyland stated that work is being initiated on the City's Comprehensive Plan and this area is <br />included in one of the first neighborhood groups to be studied. Council directed staff at the work <br />session on June 19, 1996, to defer any rezoning requests in study areas until completion of that <br />portion of the plan. For that reason, it may be appropriate for this matter to be delayed. She <br />stated that the applicant is present to discuss his options. <br />Ms. Wyland noted that this item has been discussed at a previous Council meeting. She noted <br />that a four-fifths (4/5) vote is required for passage. Mr. Hanson is considering withdrawing his <br />request. <br />Council Member Kuether stated that she will not support this request. <br />Council Member Neal stated that Mr. Hanson owns the property and he should be able to do <br />what he wants with it. <br />
