• <br />• <br />COUNCIL WORK SESSION OCTOBER 9,1996 <br />Agency will only allow an experimental mound septic system to be installed on their lot. <br />This type of system is not guaranteed to work and would have to be removed if it failed. <br />The Leese' also contend that the Apollo Drive improvement project had a negative <br />impact on their property because additional water was allowed to run-off onto their <br />property. <br />The Leese' requested that the City hook them up to the sewer utility located on Apollo <br />Drive at no cost to the Leese'. In return, the Leese' would be required to connect to the <br />sewer utility when it is constructed on Marvy Street in front of their home and also to be <br />required to be assessed at the same rate as other residents on Marvy Street. <br />Staff noted that a drainage easement was constructed on the Leese lot when the area was <br />platted. The configuration of the drainage easement limits the areas on the lot for <br />construction of another septic system. Staff also noted that the soil boring tests performed <br />prior to the issuance of the building permit and the septic system permit indicated that the <br />lot was a buildable lot at that time. The water table was lower than it is at this time. <br />The City Attorney has reviewed this matter and feels that the ' o al obligation <br />to the Leese'. <br />Staff outlined options for Council consideration: <br />1. The City could extend sewer services to th r = • me from Apollo Drive at a cost <br />of approximately $8,000. <br />2. The City could extend sew • a', e ces down Marvy Street. This project <br />would allow other ho = y St et to connect if they desired. Currently, the <br />lots fronting on M of in the MUSA. The City would have to get <br />MUSA design . + s f • ese lots either by requesting MUSA from Metropolitan <br />Council or by A from another location. <br />3. The Leese' could tend the sewer services to their home from Apollo Drive and then <br />sell the rear of their lot fronting on Apollo Drive to finance the sewer extension costs. <br />Staff recommended that Option 2 be adopted. The City would be required to prepare a <br />public improvement project and the actual construction would not begin until spring. This <br />means that the Leese' would have to go through another spring thaw and more septic <br />problems. <br />Council directed the City Attorney to make it clear to the Leese' that the City did not <br />error in issuing the building permit and septic system permit. Staff was also directed to <br />determine how many residents along Marvy Street are in need of sewer utilities. <br />Staff will prepare an outline of the procedure required for implementing Option No. 2 and <br />• bring this information to the next work session. <br />PAGE 3 <br />
