COUNCIL MINUTES OCTOBER 14, 1996 <br />Council Member Bergeson moved to adopt Resolution No. 96 - 140, as presented. Council <br />Member Lyden seconded the motion. Motion carried unanimously. <br />Resolution No. 96 - 140 can be found at the end of these minutes. <br />PUBLIC HEARING, VACATION OF A TEN FOOT (10') DRAINAGE EASEMENT ON <br />PARCEL B, 7702 LAKE DRIVE, DAVID AHRENS <br />Mr. Ahrens explained that this parcel is located immediately north of 77th Street and east of <br />Lake Drive. In May of 1996 Council approved a minor subdivision and lot reconfiguration for <br />the property located at 7702 Lake Drive. Prior to this action in May, Parcels B and C were <br />combined and the property owners agreed that they would combine Parcels A and B, separating <br />C. The result was the formation of one parcel with a property line and 10 -foot drainage easement <br />running through the property. <br />Mayor Landers opened the public hearing at 7:37 P.M. <br />There being no public input, Council Member Kuether moved to close the public hearing at 7:38 <br />P.M. Council Member Lyden seconded the motion. Motion carried unanimously. <br />Consideration of Resolution No. 96 -141, Vacating Drainage Easement on Parcel B, 7702 <br />Lake Drive <br />Council Member Kuether moved to adopt Resolution No. 96 - 141, as presented. Council <br />Member Bergeson seconded the motion. Motion carried unanimously. <br />Resolution No. 96 - 141 can be found at the end of these minutes. <br />PUBLIC HEARING, VACATION OF A PORTION OF DRAINAGE EASEMENT, LOT <br />11, BLOCK 1, LINO AIR PARK NORTH <br />Mr. Ahrens explained that this public hearing is being held in response to Carl Johnson's request <br />that a portion of the drainage and utility easement over his property described as Lot 11, Block 1, <br />Lino Air Park be vacated. The easement was originally requested by the Rice Creek Watershed <br />District as a ponding and flowage easement with its Permit No. 94-142, Final Site Drainage Plan <br />for Lino Air Park North. The RCWD has since determined that vacating a portion of this <br />easement would be acceptable. Kurth Surveying has prepared a legal description describing the <br />proposed perpetual ponding and flowage easement. Staff recommended adoption of Resolution <br />No. 96 - 142. <br />Council Member Lyden questioned RCWD's control over subsequent runoffs as opposed to <br />volume. Mr. Ahrens responded that he feels comfortable with this proposal, referencing <br />correspondence dated August 28, 1996 from Kate Drewry, District Administrator, Rice Creek <br />Watershed, indicating the District's approval of the project. <br />Mayor Landers opened the public hearing at 7:40 P.M. <br />There being no public input, Council Member Kuether moved to close the public hearing at 7:41 <br />P.M.
