COUNCIL MINUTES OCTOBER 14, 1996 Council Member Kuether moved to adopt Resolution No. 96 - 132, as presented. Council Member Lyden seconded the motion. Motion carried unanimously. Resolution No. 96 - 132 can be found at the end of these minutes. Resolution No. 96 - 133, Adopting Assessment, Lino Air Park North - Mr. Ahrens explained that this project is an extension of Carl Street located on lots 10 through 14 of Lino Air Park North on the south side of Carl Street. Assessment is based on the following: Surface water management planning fees for sewer and water management The total assessment amount is $16,132.25. Mayor Landers opened the public hearing at 7:48 P.M. Tom Schmelzer, 398 Carl Street, requested clarification of the assessment charges, and whether or not this assessment is against the developed lots or Lino Air Park North as a whole. Mr. Ahrens explained that the assessment is just for the developed lots, and that the charges are to cover storm sewers, ditch cleaning, etc. which occur with developments included in the project area. Carl Johnson, Lot 11, asked if any of the assessment would be charged to individual lots. Mr. Ahrens explained that each lot would receive an assessment, paid by the developer. Clayton Wendt, 391 Thomas Street, asked about drainage work done in the Air Park area; specifically, what notification was required to the Air Park Association as well as to area residents. Additionally, he asked about an easement for the ponding installed on Air Park property. Mr. Ahrens was unable to respond to the question regarding notification requirements. He did state that for development purposes it was necessary to re-route Carl Street. With respect to the ponding, the RCWD required the ponding for the same purposes, and was of the opinion that proper easements were obtained. Mr. Ahrens offered to work with Mr. Wendt to resolve the easement issue. There being no further input, Council Member Kuether moved to close the public hearing at 7:58 P.M. Council Member Bergeson seconded the motion. Motion carried unanimously. Council Member Kuether asked Mr. Hawkins if there was any problem in going ahead with adoption of the assessment resolution in light of Mr. Wendt's questions. Mr. Hawkins indicated that the resolution should go forward, but that permits should not be issued until drainage issues are thoroughly investigated. Council Member Lyden asked if the lots would be buildable if the ponds were contained entirely within each one. Mr. Ahrens could not respond without further evaluation of the properties involved. Council Member Lyden moved to table consideration of Resolution No. 96-133. Council Member Bergeson seconded the motion. Motion carried unanimously. 8
