COUNCIL MINUTES MAY 12, 1997 <br />Council Member Kuether expressed concern that the owner of Lot 18 was not notified. Mr. <br />Kelly speculated they have no idea of the direction the house on Lot 19 was supposed to face. <br />Council Member Bergeson asked why the south boundaries of these lots do not match up. Ms. <br />Wyland explained this is how those lots were platted. <br />Mr. Wessel noted staff has consistently indicated the Council set these conditions so the property <br />owners have not been notified -- that would be the responsibility of the developer. <br />Council Member Kuether moved to not reconsider Council conditions for Lot 19, Block 5, <br />Behm's Century Farms, 256 Palomino Avenue, requiring Lot 19 to have a northerly orientation, <br />thereby denying the proposed construction. Council Member Bergeson seconded the motion. <br />Motion failed with Bergeson and Kuether voting aye and Landers, Lyden, and Neal voting nay. <br />Council Member Lyden moved to reconsider Council conditions for Lot 19, Block 5, Behm's <br />Century Farms, 256 Palomino Avenue, requiring Lot 19 to have a northerly orientation, thereby <br />allowing the proposed construction conditioned upon written response of support from the owner <br />of Lot 18. Council Member Neal seconded the motion. Motion carried with Landers, Lyden, <br />and Neal voting aye and Bergeson and Kuether voting nay. <br />Consideration of Preliminary Plat, Ordinance No. 02 - 97 Rezone, MUSA Designation, <br />Miller's South Glen (4/5th Vote) - Ms. Wyland explained this item was tabled from the <br />Council's February meeting. The 120 -day review time for this item expires on May 23, 1997. <br />Therefore, action must be taken unless Mr. Carlson agrees to an extension of time. She advised <br />Mr. Carlson would like the Council to approve his request and has agreed to provide $2,000 per <br />lot to be used for the improvement of Ware Road. He has also agreed to phase his development <br />as determined by the Council. Ms. Wyland reported the Planning and Zoning Board held a <br />public hearing in February and recommend approval with the following conditions: <br />1. The City vacate the existing 20 -foot wide roadway easement which currently traverses the <br />subject property. <br />2. The City Council approve the requested cul-de-sac length variance based on a finding that <br />such variance will not affect the general intent of the City's street construction standards <br />and that the Public Works Director, City Engineer, and City Administrator find such <br />variance to be acceptable. <br />3. Meadow Lane is shifted eastward to align with Willow Court to eliminate a street jog and <br />Lot 6 having direct access from 62nd Street. <br />4. All street names are subject to approval by the City. <br />5. All wetland mitigation plans are subject to review and recommendation of the Rice Creek <br />Watershed District. <br />6. The submitted grading and drainage plan is subject to review and approval by the City <br />Engineering. <br />7. A utility plan is submitted subject to review and approval of the City Engineer. <br />PAGE 1 1 <br />
