COUNCIL MINUTES MAY 12, 1997 <br />• 8. The City Engineer provide comment and recommendation in regard to easement <br />establishment. <br />9. A determination must be made that Ware Road can accommodate the proposed <br />development. <br />10. Phasing for the development shall occur as follows: <br />a. 1997 - 15 lots <br />b. 1998 - 34 lots <br />11. Comments of other City staff. <br />• <br />Ms. Wyland noted the condition that Mr. Carlson participate in the cost to construct Ware Road <br />of $2,000 per lot. She said the Council needs to act on this request unless Mr. Carlson requests <br />to extend the time limit. <br />Mayor Landers noted that by giving rezoning and MUSA expansion to Miller's South Glen, <br />without knowing the Ware Road situation, is similar to putting the "cart before the horse." He <br />noted Ware Road could be voted down on the November, 1997 election ballot. It may not be <br />reconstructed for three to four years, so to consider approval of this plat at this time may be <br />premature. <br />Council Member Bergeson stated his support of the request. He stated the Council has already <br />decided something must be done about Ware Road and this layout proposes a minimal impact <br />with only 15 houses the first year. He pointed out this has the unanimous support of the Planning <br />& Zoning Board and it is R -1X which tends to be houses with values in excess of $200,000, <br />which is a nice addition to the City's tax base. <br />Council Member Kuether stated this is a good point. The Council has already committed to the <br />need to do something about Ware Road. She suggested it may be best to construct the homes <br />prior to reconstruction of Ware Road to limit damage to the roadway. However, the Council has <br />indicated no more access on Ware Road until it is reconstructed. <br />Mr. Carlson, applicant, stated he intends to minimize the impact by dividing the plat into two <br />phases. He advised he has started grading one-half of the project and would like to complete <br />grading so growth can be established behind existing houses and ponds can be placed. He <br />estimated it will take three months (September) before utility work can be constructed. He <br />explained if it is not approved at this time and he is pushed into winter construction, he may need <br />to reconsider whether he should contribute towards Ware Road (due to increased cost to <br />construct during winter weather conditions). Mr. Carlson asserted no one objected to his <br />proposed development at the public hearing, they just want him to contribute towards Ware <br />Road. <br />Jim Hughes, 6665 Ware Road, stated his concern is that the purpose of the road improvement is <br />to make that site buildable. However two or three years ago, an easement was vacated that <br />extended 62nd Street to Hodgson Road. If this had not been vacated, he asserted this Ware <br />Road would not need to be improved. Mr. Hughes stated he believes an assessment of $2,000 is <br />PAGE 12 <br />
