• <br />• <br />COUNCIL MINUTES MAY 12, 1997 <br />Mayor Landers asked Mr. Carlson if he would like to request an extension. Mr. Carlson stated <br />this is a financial decision since lenders are involved who may withdraw their commitment. He <br />asked if this must be decided tonight. Mr. Wessel advised due to the time constraint, it must be <br />considered tonight. <br />Mr. Hawkins noted the reasons detailed by the Planning Commission to approve and advised that <br />if denied, the Council will need to state rationale for denial. <br />Mayor Landers declared a recess at 8:08 P.M. The meeting was reconvened at 8:17 P.M. <br />Mr. Carlson explained in the phasing process, he would be willing to pay the $98,000 assessment <br />on the front end (Phase I) which will provide the City with funds over a shorter period of time. <br />Mayor Landers stated he still has concerns but believes the $98,000 would be lost which would <br />impact the Ware Road project. Therefore, he will support approval of the request. <br />Council Member Kuether moved to approve the FIRST READING of Ordinance No. 02 - 97, <br />rezoning Miller's South Glen from R, Rural, to R -1X, Single Family Executive. Council <br />Member Bergeson seconded the motion. <br />Greg Harvey, 440 Coyote Trail, stated there is a specific issue not being addressed tonight and <br />requested permission to address the Council. Mayor Landers consented. Mr. Harvey advised his <br />property directly abuts the Miller's South Glen addition and there were two specific conditions <br />addressed by the Planning and Zoning Board which have not been mentioned; going forward <br />with the Ware Road improvements, and a drainage issue with the properties that adjoin Miller's <br />South Glen on the north. <br />Mr. Harvey explained that pursuant to that, Mr. Carlson had a survey conducted and a letter <br />recently came out saying all but one lot is acceptable and he will work with the owner of that lot <br />to bring it up to the minimum specifications of the development plan. He asserted a majority of <br />the lots on that north side of Miller's South Glen are several inches off the bare minimum of the <br />development plan and asked what will be done to resolve this problem prior to the development <br />of the Miler's South Glen project. <br />Mr. Ahrens stated he has copies from Mr. Carlson's engineer and residents, and he met with Mr. <br />Brent regarding a drainage problem. He stated it is his understanding that Mr. Carlson's engineer <br />has forwarded plans to correct that issue which was also approved by the property owner and will <br />be completed shortly. <br />Mr. Carlson confirmed his engineering firm surveyed each individual lot and has been approved <br />according to the minimum development standards. He stated all lots are corrected to those <br />minimum heights to the window levels and drainage ditch. He advised his engineer prepared and <br />submitted a drainage plan and the new grading will improve that situation. <br />PAGE 14 <br />
