CITY COUNCIL WORK SESSION DECEMBER 8,1999 <br />Staff noted the developer of the subdivision has an issue with the vacation of Elmcrest <br />and roadway alignments within the subdivision. Staff also noted the water service will be <br />limited to single family residential. <br />Council expressed concern regarding the emergency access in the south/east part of the <br />City if Elmcrest is eliminated. Staff advised that issue has been discussed and will be <br />discussed further with emergency personnel. Cedar will be upgraded to allow for <br />emergency access. <br />ARNT/ALLEN EASEMENT NEGOTIATION, JOHN POWELL <br />Staff advised the Arnt/Allen easement issue relates to the regional pond, wetland <br />mitigation, and greenways. Negotiations have been held for the City to obtain 9 — 10 <br />acres of land at a cost of $457,000. The purchase will be financed and recovered through <br />the Surface Water Management Fund. <br />This item will appear on the regular on the agenda at the regular C eting <br />Monday, December 20, 1999. <br />GAS FRANCHISE FEE, LINDA WAITE SMITH <br />Staff distributed a memo regarding Minnegasc <br />included a list of advantages and disadvantag <br />franchise fee, a spreadsheet with the e <br />ranging from one percent to five <br />reconstruction costs for the ne <br />gotiations. The memo <br />ter fee versus a percentage <br />that would result from fees <br />e City Engineer's estimate of road <br />Staff suggested the Cousi dedicating a large percent of the franchise fee to <br />road reconstructio <br />nistration fees are paid. <br />Council suggested o'bility of an escalating fee built into the contract. Council also <br />expressed concern r=.'. ding any beginning legal fees being paid out of the General Fund. <br />Council directed staff to move forward with a gas franchise fee based on 3% with the <br />addition of a clause regarding an escalating fee. The gas franchise fee will initially pay <br />for any start up and legal costs. No start up or legal fees will come from the General <br />Fund. After the initial fees are paid, it is anticipated that 100% of the gas franchise fee <br />will to the road reconstruction fund with the percentage never to be less than 50%. <br />YMCA BOARD, MAYOR SULLIVAN <br />Mayor Sullivan advised the YMCA has agreed to designate a seat on their Board for a <br />City staff person or Council Member. Typically, the YMCA does not designate seats. <br />The City Administrator has been asked to be the official City representative. <br />3 <br />
