COUNCIL MINUTES NOVEMBER 13, 2000 <br />Council Member Reinert inquired about the developer breaking ground. Staff advised the developer <br />would like to break ground before it freezes. Staff is recommending approval with a stipulation. <br />Normally there are the signatures of all interested properties. An alternative is to have a document <br />called Consent to Plat. Staff explained the difference relating to a Consent to Plat. Staff advised the <br />documents are in order but have not yet been signed. Staff recommended Council approve this item <br />with the stipulation that the city will not sign the final plat until all Consent to Plat documents are in <br />and signed. <br />Council Member Reinert stated he is uncomfortable voting on a final plat with so many conditions. <br />History on this included the Council voting on it before they should have. He stated he would like <br />more time to review. <br />Mr. Tom Rooney, attorney for the landowner, came forward and explained the background of the issue <br />regarding overpayment. He stated an agreement has finally been reached. Four (4) signatures were <br />obtained today. Owners will also sign the Consent to Plat documents. tated he would appreciate <br />resolution on this matter this evening. <br />Mr. Lessard, developer of the Dairy Queen, came forward an ter weather will be a <br />problem. The footings need to be in before the winter or p ct w' be delayed another 3-4 <br />months. Mr. Rooney indicated Mr. Rehbein will sign the agreement. <br />Council Member O'Donnell clarified that he does not need to review the agreement. He would like <br />the agreement to be signed. <br />The City Engineer advised he will revise the agreement and prepare it for signatures. <br />Mayor Bergeson reviewed the two suggested conditions noting that Council Member Reinert also <br />suggested tabling this issue. <br />10 <br />
