• <br />COUNCIL MINUTES FEBRUARY 12, 2001 <br />Council Member Reinert moved to adopt Resolution No. 2001— 26, extending the permit to April 30, <br />2002. Council Member Carlson seconded the motion. Motion carried unanimously. <br />Resolution No. 2001— 26 can be found in the City Clerk's office. <br />FIRST READINGS, Ordinance 01— 01 and 02 — 01, Rezone and Comprehensive Plan <br />Amendment to Allocate 2.55 Acres of MUSA Reserve (4/5 Vote Required for Each Ordinance), <br />and Resolution No. 01— 06, Approving Preliminary Plat for Behm's Farm Park Addition (3/5 <br />Vote Required), Century Farms Development, Jeff Smyser — adoption of the agenda, this <br />item was deleted. <br />FIRST READING, Ordinance No. 03 — 01, Rezone City Hall Park from Rural to Public Semi - <br />Public to Allow for the Location of a PCS Tower, (4/5 Vote Required), Qwest Wireless LLC, <br />Jeff Smyser City Planner Smyser advised Qwest Wireless LLC has submitted a request for the City <br />to rezone City Hall Park. Qwest proposes to construct a 135 -foot high tower for antennas for wireless <br />telephone service. Such towers are not allowed in the Rural zoning di ty Hall Park currently <br />is zoned Rural. Towers are allowed in PSP Public Semi -Public dihas requested <br />rezoning City Hall Park to PSP. <br />The Federal Communications Act of 1996 requires that i re ons "shall not prohibit or <br />have the effect of prohibiting the provision of pers r . 're ervices." This does not mean the <br />City must allow towers wherever a wireless com . one. However, the City must provide <br />locations where a wireless provider can h ovide service. The tower itself requires <br />only an administrative permit if the z oposed site allows the tower. <br />City Planner Smyser presentee ysisof the application noting a neighborhood meeting was <br />held January 4, 2001, for th._ ',;c t the area. The residents who attended would prefer the tower <br />not be placed on the p , �a se �; e. However, they acknowledged the constraints of the federal law. <br />The existing location rink lights is a problem for one resident, an issue that may be <br />resolved by adjusting li • 1. ement and aiming. <br />The Park Board discussed this application at its January 4, 2001, meeting. The Park Board <br />acknowledged the constraints of the federal law and had no serious oppositions to the proposal. <br />The Environmental Board reviewed the project on January 3, 2001. That Board recommends finding <br />an alternative location away from Rondeau Lake, preferably the City's water towers. As noted as part <br />of the analysis, the water towers do not fill Qwest's service needs. <br />The Planning and Zoning Board reviewed this item and approved the rezoning request on January 10, <br />2001, based on the factors considered for a zoning amendment. <br />Mr. Gary Lysiak, Owl Engineer, came forward and presented his analysis of the tower location study <br />conducted by staff. <br />
