COUNCIL MINUTES FEBRUARY 26, 2001 City Planner Smyser noted the Planning and Zoning Board also recommended approval on a 4-0-1 (Rafferty) vote to approve this minor subdivision based on conditions at their February 13, 2001 meeting. City Planner Smyser reviewed the information regarding zoning for commercial/residential comparing the existing land use map to the proposal. Mr. Rockey Goertz came forward and referred to a sketch of the concept plan noting the plan will go through the City process. He stated the land needs to be split up for a business deal. The street layout does have the County's blessing. The right -in right -out option has been approved. The preliminary plat will be submitted in March 2001. Council Member Carlson asked if the right -in right -out will be at the same point as the access. Mr. Goertz stated the right -in right -out will be a little to the north of the access. The access will then be eliminated. Council Member Carlson moved to adopt Resolution No. 01 — b`d o he following conditions: 1. SECOND READING, Ordi ` o. — 01, Rezone City Hall Park from Rural to Public Semi -Public to allow fo , the Lo ' i n of a PCS Tower, (4/5 Vote Required), Jeff Smyser — City Planner Smyser advised t � ncil approved the first reading of Ordinance No. 03 — 01 on February 12, 2001. This is e s cond reading. After approval of the second reading, the ordinance will be published in the new aper. The ordinance becomes effective 30 days after the publication date. To summarize, Qwest proposes to construct a 135 -foot high tower for antennas for wireless telephone service. Such towers are not allowed in the Rural zoning district. City Hall Park currently is zoned Rural. Towers are allowed in a PSP Public Semi -Public district. Qwest has requested rezoning City Hall Park to PSP. Council Member O'Donnell moved to approve the SECOND READING, of Ordinance No. 03 — 01, as presented. Council Member Reinert seconded the motion. Council Member Carlson voted yea. Council Member O'Donnell voted yea. Council Member Reinert voted yea. Acting Mayor Dahl voted yea. 8
