COUNCIL MINUTES MARCH 11, 2002 <br />Councilmember O'Donnell questioned how this type of ordinance would be enforced. Community <br />Development Director Grochala stated the ordinance would be enforced through the self governing <br />and cooperation of the lake users, the Anoka County Sheriff's Department and the Department of <br />Natural Resources. <br />Mr. Perry added the Anoka County Sheriff's Department would be responsible for enforcing the no - <br />wake zone, in consort with the local Conservation Officer. <br />Councilmember O'Donnell expressed concern for the number of different opinions regarding what <br />the actual problem is and where the no -wake zone boundary line should be drawn. He questioned <br />whether there would be a more flexible manner to address the situation since it often takes months to <br />change an ordinance when two different cities are involved. He was concerned, if the ordinance was <br />found to not have an impact on the situation, how could the City more rapidly respond if needed to <br />adjust the solution. <br />Councilmember Reinert stated he too was concerned about imp sri ordinance and restricting <br />rights only to find the ordinance did not solve the problem. T ledged that the great blue <br />heron rookery is failing and the City should want to do all t . c . to limit the activity around the <br />island since this may help solve the problem. However, e• during the Council work session <br />comments were made that rookeries fail but the reaso or is is uncertain. <br />Councilmember Reinert stated he supported pass g .roposed ordinance in order to keep activity <br />away from the island for a period of time in or d rmine whether this action is helping and, if <br />so, the ordinance could be kept in place. He felt because the City Council <br />was being asked to act on the ordinance 1 .rde to solve a problem without a great deal of facts, they <br />should keep the door open to readdre • dinance in the future in order to fully determine the <br />reason for the abandonment of the i ,, e d. e to. did not want the great blue herons to leave the City, <br />particularly since the bird is >_ City's ol, and he felt it would be foolish to not address the <br />situation. However, he did n. : M d• ss the problem without solving it. He asked if it would <br />be possible to enact a tempor rdinance for a period of two years. City Attorney Hawkins <br />responded affirmatively. <br />Councilmember Reinert felt enacting an ordinance that would expire in two years would force the <br />City Council to readdress and monitor the problem. <br />Regarding the notion of a non -ordinance solution, Mayor Bergeson believed this would only be <br />possible if the lake were private with no public access. However, this is not the case and he did not <br />believe it would be possible to enforce a no -wake zone without taking formal action. <br />Councilmember Carlson moved to approve the FIRST reading of Ordinance 03-02, Regulating the <br />surface use of motorized watercraft on Peltier Lake in the Peltier Lake Island area, to include the <br />following no -wake zone description: <br />22 <br />
