• <br />• <br />• <br />CITY COUNCIL WORK SESSION JANUARY 22, 2003 <br />APPROVED <br />Councilmember Carlson stated she does have serious legal concerns with the ordinance <br />and wants to review the information from the City Attorney. <br />Councilmember Carlson stated she is also worried about the 20% figure and if that is a <br />Council prerogative. <br />Councilmember Carlson asked if it is possible to give two years worth of building to a <br />developer at one time. Community Development Director Grochala advised giving a <br />developer two years worth of building at one time is a possibility. <br />Councilmember O'Donnell stated he thought the City would be phasing a lot of <br />development. Community Development Director Grochala stated the City will be <br />phasing lots of projects. It is possible to tweak the process to approve final plats for a <br />phase 1 and phase 2 project in the same year but not allow the permits for phase 2. <br />Councilmember Carlson asked if the Council would be receiving a new copy of the <br />Growth Management Ordinance. Community Development Director Grochala stated that <br />depends on what type of information is received from the City Attorney. <br />Councilmember Carlson stated she is concerned that the City is limiting single-family <br />homes but leaving the door open for multi -use and commercial building. She stated she <br />needs to review the additional language from the City Attorney. <br />Community Development Director Grochala stated the Growth Management Ordinance <br />will allow the City to manage growth at 147 new homes built per year. <br />Mayor Bergeson stated he would like to know the result if the ordinance is challenged <br />and the City does not win the challenge. <br />Community Development Director Grochala stated the biggest concern in relation to the <br />ordinance is the properties that are within the MUSA and want to develop after the City <br />has reached the 147 goal. <br />Mayor Bergeson stated it is important to get the ordinance in place as soon as possible. <br />The ordinance can be amended in the future if necessary. <br />Community Development Director Grochala noted the disagreement is on the numbers in <br />the ordinance, not the ordinance itself. <br />This item will appear on the regular Council agenda Monday, January 27, 2003, 6:30 p.m. <br />SUBDIVISION ORDINANCE, MICHAEL GROCHALA <br />
