COUNCIL MINUTES OCTOBER 13, 2003 <br />APPROVED <br />S776 F. Consideration of Resolution No. 03-179, Approving Final Plat, Marshan Lake Industrial <br />777 Park, Michael Grochala <br />778 <br />779 Community Development Director Grochala presented the Staff report, noting that included as a <br />780 condition is that they have final review and approval of title information by the City Attorney. <br />781 <br />782 Councilmember Carlson commented that she believes they all received a letter about the road. <br />783 Community Development Director Grochala stated that Ms. Weinhoff owns the tax service, which is <br />784 the property east of the proposed industrial park. He indicated that when going through the public <br />785 hearing, Ms. Weinhoff expressed concern with the turn lane. He advised it is needed due to the <br />786 amount of traffic. He further advised that an issue brought up at Planning and Zoning is that Ms. <br />787 Weinhoff's property has two existing driveways, and the turn lane, as proposed, started to conflict <br />788 with one of the driveways. He indicated Staff had discussions with Anoka County and they have no <br />789 concerns with moving the turn lane south of Ms. Weinhoff's driveway. He noted the turn lane is <br />790 being constructed in front of her property but in the County right-of-way, and is the only option to <br />791 move traffic. He noted the location of this street was in the center of the road section, and it is the <br />792 County's requirement to maximize spacing to at least a quarter of a mile. He noted it does go in front <br />793 of the tax service parcel, but is not a unique situation, as they often see right turn lanes start in front <br />794 of someone's property, and again, it is in the County right-of-way. <br />795 <br />796 Community Development Director Grochala noted another concern was with Mr. Buckle's property <br />797to the north. When the surveyor stakes went up, they encroached on where he thought his property <br />.798 line ended. They are working with the developer to save the oak trees along the property line that <br />799 Mr. Buckle had believed were on his property, but are not. <br />800 <br />801 Councilmember O'Donnell moved to adopt Resolution No. 03-179, approving the Final Plat for <br />802 Marshan Lake Industrial Park. Consideration of SECOND READING of Ordinance No. 21-03, Amending the Lino <br />809 Lakes Zoning Ordinance Relating to Personal Services in the GB District, Jeff Smyser <br />810 <br />811 City Planner Smyser reviewed the Staff report, noting with approval of the second reading the <br />812 ordinance will be published on October 21, 2003 and go into effect 30 days later. <br />813 <br />814 Councilmember Reinert moved to approve the SECOND READING of Ordinance No. 21-03 <br />815 amending the Lino Lakes Zoning Ordinance relating to personal services in the GB District. <br />816 Councilmember Carlson seconded the motion. <br />817 <br />818 Councilmember Reinert voted yea. Councilmember Carlson voted yea. Councilmember Dahl voted <br />819 yea. Councilmember O'Donnell voted yea.
