COUNCIL MINUTES FEBRUARY 9, 2004 <br />APPROVED <br />186 Mayor Bergeson asked him to review once more Staffs recommendation. Community Development <br />•87 Director Grochala stated their recommendation is a declaration of no significant impact. He noted the <br />188 resolution will be forwarded onto all involved agencies, as well as published in the EQB Monitor. <br />189 <br />190 Councilmember Stoltz moved to adopt Resolution No. 04-19 making a negative declaration on the <br />191 need for an Environmental Impact Statement for Legacy at Woods Edge. Councilmember Reinert <br />192 seconded the motion. <br />193 <br />194 Councilmember Carlson stated as a housekeeping issue, this refers again to the Lino Lakes <br />195 Development Guide, which the City Council has not approved. Community Development Director <br />196 Grochala indicated it will be a part of it. <br />197 <br />198 Councilmember Carlson stated she did attend the Environmental Board meeting where they passed <br />199 this, and they were of the same mind as Anoka County Park and Recreation, who said: <br />200 'From our perspective, the consultants, SEH, have done a thorough task of identifying and <br />201 mitigating impacts on the adjacent wetlands and the surrounding natural environment. We are <br />202 glad to see that the proposed land use will be buffered by the existing woodlands and <br />203 wetlands. We are also encouraged to see that these areas will be designated as out lots held in <br />204 public ownership.' <br />205 <br />206 Councilmember Carlson stated she will vote yes, because she thinks they have done a thorough job <br />207 also. She noted that funding of that intersection still concerns her. <br />208 <br />209 Motion carried unanimously. <br />•10 <br />211 Resolution No. 04-19 can be found in the City Clerk's office. <br />212 <br />213 D. Consideration of Resolution No. 04-18, Approving MUSA Extension, Conditional Use <br />214 Permit and Variance, VFW, Jeff Smyser <br />215 <br />216 City Planner Smyser summarized the Staff report, indicating the resolution incorporates all three of <br />217 the necessary actions. <br />218 <br />219 Mayor Bergeson noted there are eighteen conditions of approval. He asked if the VFW is aware of <br />220 these conditions and can accommodate them. A representative of the VFW indicated they are aware <br />221 and will accommodate them. <br />222 <br />223 Councilmember Stoltz asked what the parking requirements are for Lino Lakes. City Planner Smyser <br />224 advised for restaurants and bars it is 10 spaces for every 1000 square feet of building space, and they <br />225 add one stall per employee, per shift. <br />226 <br />227 Councilmember Reinert moved to adopt Resolution No. 04-18 approving the allocation of 2.24 acres <br />228 of Commercial MUSA, approving the amendment of a conditional use permit, and approving <br />229 variances for setbacks for the Circle -Lex VFW site, 7868 Lake Drive.
