Consideration of Resolution No. 04-31 approving Comprehensive Plan <br />41191 Amendment from Low Density Unsewered Residential to Low Density Sewered <br />192 Residential. <br />193 <br />194 Community Development Director Grochala summarized the Staff report, noting the following <br />195 findings: <br />196 1. The proposed land use amendment lies within an area designated as a Stage 1 Growth <br />197 Area and is within the existing Metropolitan Urban Service Area. <br />198 2. The proposed land use amendment will allow for infill development. <br />199 3. The proposed land use amendment will allow the extension of public utilities to provide <br />200 for the eventual need to phase out existing on-site private utilities. <br />201 <br />202 Community Development Director Grochala indicated for Preliminary Plat, Staff recommends <br />203 approval with the following conditions, which he explained: <br />204 1. The City approves the Comprehensive Plan Amendment to change the land use from Low <br />205 Density Unsewered Residential to Low Density Sewered Residential. <br />206 2. The City Council orders the sanitary sewer and water improvements. <br />207 3. A 20 feet wide conservation easement shall be provided, adjacent to County Ditch 10, <br />208 across Lots 1-4. <br />209 4. Building Permit applications shall include a tree preservation plan and a grading plan in <br />210 conformance with the approved grading plan. <br />211 5. Tree cover will be evaluated against Firewise requirements, subject to review by the City <br />212 Forester. <br />213 6. The Developer shall enter into a Development Contract with the City. <br />0214 7. The Developer shall provide a 10 -foot wide trail easement adjacent to Lake Drive, which <br />215 would overlay the required 10 -foot drainage and utility easement. <br />216 8. Parkland dedication shall be in the form of cash payment in the amount of $6,600. <br />217 9. Applicant shall provide Quit Claim Deeds to adjacent property owners for the Outlots. <br />218 <br />219 Councilmember Carlson noted when they first started to talk about this there was a gentleman at the <br />220 eastern end of the property who was concerned that sewer and water would reach his property so he <br />221 had the option to connect in the future. <br />222 <br />223 Community Development Director Grochala stated TKDA has addressed this in their plans. He <br />224 indicated they have a sanitary sewer and manhole stubbed into the property for future connection. <br />225 <br />226 Councilmember Carlson asked if someone has a working sanitary sewer, and does not wish to hook <br />227 up at this time, what the benefits are to them on this project. <br />228 <br />229 Community Development Director Grochala stated they went through the 429 process and the project <br />230 was turned down by the property owners. He indicated the City decided to go ahead with the project <br />231 anyway, so if property owners do not hook up, they will not pay an assessment at this time. He noted <br />232 that at the time of hook up, the homeowner would pay the assessment, with the option to spread <br />233 payments over 15 years just as is an option now. <br />234 <br />235 Councilmember Stoltz moved to adopt Resolution No. 04-31 approving an amendment to the <br />236 Comprehensive Plan.
