Consideration of Resolution No. 04-02, approving allocations of MUSA Reserve and <br />253 Preliminary Plat, Justin's Preserve, Jeff Smyser <br />254 <br />255 City Planner Smyser summarized the Staff report, indicating approval of the project should include <br />256 the following conditions: <br />257 1. Lot 1 shall connect to city sanitary sewer and water. <br />258 2. Issues discussed in the City Engineer review memo must be addressed to the City Engineer's <br />259 satisfaction. <br />260 3. Park dedication of $1,665 shall be paid. <br />261 4. Prior to approval of the final plat by City Council, the applicant shall submit proof that the <br />062 powerline easement has been confined. <br />263 5. The new plat dated January 16, 2004, must obtain approval by the Rice Creek Watershed <br />264 District prior to final plat approval by the City Council. <br />265 <br />266 Councilmember Carlson asked where the driveway is located for Lot 3. City Planner Smyser stated it <br />267 is not shown on the site plan, and demonstrated the location. <br />268 <br />269 Councilmember Stoltz stated the city is allowed 147 new lots by City Ordinance with a 20% leeway. <br />270 He asked what number they would reach with this split. City Planner Smyser stated it brings them to <br />271 174, so there are two more available. He noted that a few meetings ago Staff indicated to the Council <br />272 that they were full for 2004, however there was a case that they had counted as tow lots being platted, <br />273 when really it was two lots going to three lots, so that gives them one more available. <br />274 <br />275 Councilmember Dahl moved to adopt Resolution No. 04-02 approving allocation of MUSA Reserve <br />276 and Preliminary Plat for Justin's Preserve.
