COUNCIL MINUTES MARCH 8, 2004 <br />APPROVED <br />284 i. Consideration of FIRST READING of Ordinance No. 04-04, Rezoning Certain <br />• <br />285 Real Property from LB, Limited Business District to PUD, Planned Unit <br />286 Development District. <br />287 <br />288 Community Development Director Grochala summarized the Staff report, advising there are still <br />289 several steps that need to be completed as they move through this process, and noted that Hartford <br />290 Group has been very receptive to modifications. He stated Staff is recommending rezoning, and with <br />291 regard to the Development Stage Plan, some conditions of the Planning and Zoning Board have been <br />292 addressed, and others are incorporated into the conditions of the ordinance. He read the conditions, <br />293 which are as follows: <br />294 1. Approval of the Rezoning to Planned Unit Development. <br />295 2. Title work should be prepared to verify the status of existing roadway easements, i.e., public <br />296 or private. If it is determined that they are public easements they shall be vacated in <br />297 accordance with city and state requirements. <br />298 3. A development phasing plan shall be submitted for review and approval by the City. <br />299 4. A feasibility study shall be prepared for the installation of Public Improvements. Such <br />300 feasibility study shall include estimated costs and proposed assessments to benefiting property <br />301 owners. <br />302 5. Developer shall provide an Economic Feasibility Study of the proposed project for review by <br />303 the City. <br />304 6. Developer shall provide an Operation and Maintenance Agreement for the development <br />305 covering both Public and Private Improvements for review and approval by the City. <br />306 7. Developer shall enter into a development contract with the City. <br />307 8. Acquisition by the City of parcels adjacent to the site required for proposed Lake Drive <br />.08 improvements. <br />309 9. Requirements for project identity and signage will need to be established in conjunction with <br />310 final plan/final plat approval. <br />311 10. The proposed Lakes Drive improvements will be subject to review and approval by Mn/Dot <br />312 and Anoka County. <br />313 <br />314 Mayor Bergeson stated he wants to recognize the work of Economic Development Assistant Mary <br />315 Alice Divine, who has worked hard on this for a number of months. <br />316 <br />317 Peter Coyle, attorney, commented on Community Development Director Grochala's thorough history <br />318 and presentation of the project. He stated Hartford Group is proud to be part of this project. He noted <br />319 he was joined by clients Joe and Louise Tagg who have been patiently waiting for several years for <br />320 Lino Lake's vision to proceed, and Elizabeth Kautz, Executive VP for Hartford Group, along with Jon <br />321 Theis and Patrick Sarver, Directors at the Hartford Group. He indicated he would respond to any <br />322 questions from the Council. <br />323 <br />324 Mr. Coyle advised this project strives for live, work, play interaction, and all those aspects are <br />325 hallmarks for the plan adopted. He briefly reviewed the plan Community Development Director <br />326 Grochala had outlined, noting it is a place for people to play, be on their front door steps greeting <br />327 friends, but also is a commercial area, with retail space, and a center green space for gathering. He <br />328 showed several graphics of how they envision the plan, which will be up for more discussion as the <br />329 project unfolds. He stated they are trying to provide for all the needs and amenities necessary for a <br />330 neighborhood to thrive. He commented that all the pieces seem to be coming together, and he is <br />.31 proud of that. <br />7 <br />
