COUNCIL MINUTES June 11, 2007 APPROVED •1 Council Member Carlson moved that a conditional offer of employment be extended to Heather 2 Meyer. Council Member Stoltz seconded the motion. Motion carried unanimously. 3 4 PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER 5 6 There was no report from the Public Services Department. 7 8 COMMUNITY DEVELOPMENT DEPARTMENT REPORT, MICHAEL GROCHALA 9 10 Consideration of Resolution No. 07-83, Approving Grading Only Development Agreement, The 11 Preserve — City Engineer Studenski explained that a preliminary plat was previously approved for 12 this development and a request is now before the Council for approval to begin grading on the site. 13 Staff has prepared an appropriate development contract requiring a letter of credit and a cash escrow 14 for city related costs and is presenting the contract for council consideration. 15 16 It was noted by the Council that a related request for earth material storage and excavation is pending; 17 is it appropriate to consider approval of grading previous to conclusion on that matter. 18 19 City Engineer Studenski explained that the grading contract is done in a standard format and 20 regulations allow the developer to bring in the materials necessary for grading from anywhere. 21 22 The Council discussed the possible impact of trucks hauling in dirt for the grading; City Engineer • 23 Studenski suggested there could be some adjustment of the work hours noted in the contract. 24 25 Council Member Reinert moved to approve Resolution No. 07-83 with the addition of the following: 26 1) the hours of operation should be addressed; 27 2) based on safety concerns, there may be additional restrictions required and implemented on 28 the hauling of materials. 29 Council Member O'Donnell seconded the motion. 30 31 There was further discussion of the agreement specifics and a request that more information be 32 provided on the actual number of trucks involved. Clarification was provided by the City Attorney 33 that the matter of the grading agreement and the related matter of the conditional use permit for 34 material storage could be considered together without a legal issue. 35 36 Council Members Reinert and O'Donnell withdrew the motion and second. 37 38 Council Member Reinert moved that the matter be tabled. Council Member O'Donnell seconded the 39 motion. The motion carried unanimously. 40 41 Mayor Bergeson left the chair; Acting Mayor O'Donnell took the chair. 42 43 Consideration of Resolution No. 07-84, Accepting Feasibility Study and Calling for Hearing on • 44 Improvements, West Shadow Lake Drive Area — City Engineer Studenski noted that the feasibility 45 report regarding street, storm water, sanitary sewer and watermain improvements for West Shadow 3
