COUNCIL MINUTES June 11, 2007 <br />APPROVED <br />•1 Council Member Carlson moved that a conditional offer of employment be extended to Heather <br />2 Meyer. Council Member Stoltz seconded the motion. Motion carried unanimously. <br />3 <br />4 PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER <br />5 <br />6 There was no report from the Public Services Department. <br />7 <br />8 COMMUNITY DEVELOPMENT DEPARTMENT REPORT, MICHAEL GROCHALA <br />9 <br />10 Consideration of Resolution No. 07-83, Approving Grading Only Development Agreement, The <br />11 Preserve — City Engineer Studenski explained that a preliminary plat was previously approved for <br />12 this development and a request is now before the Council for approval to begin grading on the site. <br />13 Staff has prepared an appropriate development contract requiring a letter of credit and a cash escrow <br />14 for city related costs and is presenting the contract for council consideration. <br />15 <br />16 It was noted by the Council that a related request for earth material storage and excavation is pending; <br />17 is it appropriate to consider approval of grading previous to conclusion on that matter. <br />18 <br />19 City Engineer Studenski explained that the grading contract is done in a standard format and <br />20 regulations allow the developer to bring in the materials necessary for grading from anywhere. <br />21 <br />22 The Council discussed the possible impact of trucks hauling in dirt for the grading; City Engineer <br />• 23 Studenski suggested there could be some adjustment of the work hours noted in the contract. <br />24 <br />25 Council Member Reinert moved to approve Resolution No. 07-83 with the addition of the following: <br />26 1) the hours of operation should be addressed; <br />27 2) based on safety concerns, there may be additional restrictions required and implemented on <br />28 the hauling of materials. <br />29 Council Member O'Donnell seconded the motion. <br />30 <br />31 There was further discussion of the agreement specifics and a request that more information be <br />32 provided on the actual number of trucks involved. Clarification was provided by the City Attorney <br />33 that the matter of the grading agreement and the related matter of the conditional use permit for <br />34 material storage could be considered together without a legal issue. <br />35 <br />36 Council Members Reinert and O'Donnell withdrew the motion and second. <br />37 <br />38 Council Member Reinert moved that the matter be tabled. Council Member O'Donnell seconded the <br />39 motion. The motion carried unanimously. <br />40 <br />41 Mayor Bergeson left the chair; Acting Mayor O'Donnell took the chair. <br />42 <br />43 Consideration of Resolution No. 07-84, Accepting Feasibility Study and Calling for Hearing on <br />• 44 Improvements, West Shadow Lake Drive Area — City Engineer Studenski noted that the feasibility <br />45 report regarding street, storm water, sanitary sewer and watermain improvements for West Shadow <br />3 <br />
