(2) No water area shall be filled, partially filled, dredged, <br /> altered by grading, mining or otherwise utilized or <br /> disturbed in any manner without first securing a permit <br /> from the Minnesota Department of Natural Resources, the <br /> U.S. Army Corps of Engineers, and the affected Watershed <br /> District Board. Such grading may be reviewed and <br /> approved by the Department of Natural Resources, the city <br /> engineer, the Watershed District and the design review <br /> board. <br /> (3) Water areas shall include all lakes, ponds, swamps, <br /> streams, drainageways, floodplains, floodways,natural <br /> water courses, underground water resources and similar <br /> features involving directly or indirectly the use of <br /> water within the community. <br /> Subd. 34 . Farming Operations. All farms in existence upon the <br /> effective date of this ordinance and all farms which are brought <br /> into the city by annexation shall be a permitted use. All dwelling <br /> units and structures for processing of farm goods shall require a <br /> building permit and conform to all requirements of the building <br /> code. The city council may require any new farm operation to <br /> secure a conditional use permit in the event of the following: <br /> (1) The farm is adjacent to or within four hundred (400) feet <br /> of any dwelling unit and may be detrimental to living <br /> ,^ conditions by emitting noise, odors, vibrations, hazards <br /> to safety, and the like. <br /> (2) The farming operations are so intensive as to constitute <br /> an industrial type use consisting of the compounding, <br /> processing, and packaging of products for wholesale or <br /> retail trade and further that such operations may tend to <br /> become a permanent industrial type operation that cannot <br /> be terminated as can a normal farming operation. <br /> Subd. 35. Metes and Bounds Conveyances. Parcels conveyed by <br /> a metes and bounds description shall not receive city approval for <br /> transfer unless the following conditions or other conditions <br /> stipulated in the approval have been complied with, and unless the <br /> approval of the city council has been obtained. <br /> (1) The applicant shall be required to supply the following <br /> information: <br /> (A) The proposed legal description. <br /> (B) A sketch of the proposed conveyance, at a scale of <br /> not less than one inch to 200 feet. <br /> i. t City of Lino Lakes Zoning Ordinance <br /> ADOPTED 7/13/92 <br /> 45 <br />
