SUMMARY OF COMMENTS ON EAW <br />LINO LAKES MARKETPLACE PROJECT <br />July 18, 2001 <br />This document summarizes comments received by the indicated agencies. Responses to the <br />comments follow each comment. The complete comment letters can be found attached to this <br />summary. <br />Minnesota Historical Society, State Historic Preservation Office <br />• SHPO notes that the response to question 25a of the EAW fails to indicate that the <br />archaeological survey of the parcel identified one site that was determined not to meet <br />National Register criteria. <br />City response: The EAW states that a previously recorded prehistoric archaeological site <br />is located in the project area, and that the site was evaluated to determine whether it <br />meets National Register criteria. The EAW did not specifically state that the site did <br />not meet the criteria. The clarification from SHPO is noted and included in the <br />record. <br />Minnesota Pollution Control Agency <br />• MPCA notes that the project will not exceed state ambient standards for CO and thus no <br />significant air quality impacts are expected. <br />• MPCA notes that the list of approvals and permits in item 8 of the EAW should include a <br />Clean Water Act Section 401 Water Quality Certification from the MPCA. <br />City response: This addition is noted and added to the record. <br />• MPCA notes that storm water management basins shall not be considered as wetland <br />compensatory mitigation; that existing wetlands altered by excavation or construction to <br />function as storm water basins should be counted as adversely impacted; and that, as stated in <br />the EAW, an evaluation for avoidance of impacts must be conducted. If impact is <br />unavoidable, compensatory mitigation must occur. <br />City response: The Rice Creek Watershed District (RCWD) is the Local Governmental <br />Unit under the Minnesota Wetlands Conservation Act. The project applicant has submitted a <br />sequencing analysis and mitigation plan to the RCWD. The City of Lino Lakes relies on the <br />RCWD for administration of the requirements of the Wetlands Conservation Act.
