COUNCIL MINUTES October 26, 2015 <br />APPROVED <br />129 Council Member Rafferty moved to approve Resolution No. 15-118 as presented. Council Member <br />130 Stoesz seconded the motion. Motion carried on a voice vote. <br />131 6E) Public Hearing: Consider Ordinance No. 11-15, Vacating Drainage and Utility <br />132 Easements, Outlot C and Outlot D of NorthPointe — City Planner Larsen explained that the council <br />133 is being asked to hold a public hearing and then consider approval of a vacation of certain drainage and <br />134 utility easements related to the NorthPointe development. The action would vacate a drainage and <br />135 utility easement approved originally but no longer needed because it is duplicated in action approved <br />136 on the 3rd Addition. Having the duplicate easement action could cloud the title for the developer. Staff <br />137 is recommending approval because the easement actions are identical and only one is needed. Council <br />138 Member Roeser said he understands that a redundancy can cause a title concern so he is supportive of <br />139 this request. <br />140 Mayor Reinert opened the public hearing. There being no one wishing to speak, the public hearing was <br />141 closed. <br />142 Council Member Rafferty moved to approve the 1 st Reading of Ordinance No. 11-15 as presented. <br />143 Council Member Stoesz seconded the motion. Motion carried on a voice vote. <br />144 6F) Resolution No. 15-119, Approving a 10 foot variance to allow for the construction of an <br />145 attached garage at 6602 Pheasant Run — Intern Dahl reported that the resolution approves a variance <br />146 of 10 feet to allow for construction of a new garage. <br />147 Mayor Reinert noted that he is familiar with the property and is a little surprised to see a <br />148 recommendation for a variance since that isn't something the city regularly grants. He understands the <br />149 desire for a garage. Mr. Dahl said staff has studied this situation with the Planning and Zoning Board <br />150 and feels that it is appropriate in this case. <br />151 The council heard from the property owner who is requesting the variance. He explained that he is <br />152 requesting an additional two feet with the ten recommended by staff and that is because it is too narrow <br />153 with only ten feet. City Planner Larsen noted that the 20 feet garage width allowed by a 10 foot <br />154 variance is the minimum under the city code. The applicant is requesting an additional two feet for the <br />155 garage width. The council should know that the property owner could push to the north also. <br />156 Council Member Rafferty said he's comfortable with the recommendation; if it is changed, he feels the <br />157 matter should go back to the Planning and Zoning Board. <br />158 Mayor Reinert asked if the two additional feet would be a county concern and Ms. Larson thought not. <br />159 The council discussed the value to the neighborhood of adding a garage to this property. The <br />160 additional two feet isn't unreasonable as long as the county doesn't have an issue. <br />161 Council Member Rafferty moved to approve Resolution No. 15-119 as amended to allow for a 12 foot <br />162 rather than 10 foot variance. Council Member Roeser seconded the motion. Motion carried on a <br />163 voice vote. <br />4 <br />
