b. Keep construction trash and debris from encroaching onto adjacent private <br />properties. <br />c. Respect the rights of adjacent property owners, especially those living in residential <br />properties affected by the Work. <br />1) Prohibit use of foul or objectionable language. <br />2) Avoid display of offensive materials. <br />3) Treat residents courteously during interactions. <br />5. Contractor responsible for snow removal and disposal from the Owner's property if <br />necessary to maintain access and working space during construction. <br />6. Keep existing driveways and entrances clear and available to the public and to the <br />Owner. <br />7. Working Hours <br />a. All Work shall be accomplished between the hours of 7 A.M. and 7 P.M., Monday <br />through Friday, and 9 A.M. to 5 P.M. on Saturday. Construction outside of the <br />working hours must be authorized in writing by the Owner or its representative. <br />b. No construction activity will be permitted on Sundays or holidays, unless <br />necessitated by an emergency or authorized in writing by the Owner or its <br />representative. <br />c. The Contractor must comply with all state requirements and City ordinances to <br />construct this Project. <br />d. This time frame includes all street sweeping, starting (warming up) of machinery, <br />delivery of Project equipment and materials, servicing and fueling of machinery. <br />8. The Contractor shall conduct the Work in a manner and sequence that will ensure the <br />least interference with traffic, with due regard given to the provisions for handling <br />traffic. <br />9. Work shall not commence to the prejudice or detriment of work already started. The <br />Engineer may require the Contractor to finish a section on which work is in progress <br />before starting Work on any additional sections if the opening of that section to traffic <br />is essential for public convenience. <br />10. All trenches and holes created by construction must be backfilled at the end of each <br />day. No open trenches shall be allowed on the Site overnight. <br />B. Access to Site <br />1. Access to this work site is restricted by an electronically controlled gate. The Owner will <br />make accommodations for Contractor's free passage. <br />1.07 AWARD OF THE CONTRACT <br />A. The Owner reserves the right to retain the 3 lowest Bids for a period of 60 days after the Bid <br />Date before making award. Only 1 award will be made, that being the lowest responsible <br />Bidder for the Total Base Bid, found to be in the best interest of the City, and with or <br />without consideration of Alternate Bid Items. <br />B. The Owner reserves the right to reject any or all Bids, to waive any informality or minor <br />defects where acceptance, rejection or waiving of such is deemed in the best interest of <br />the Owner, and to accept the Bid deemed most favorable to and/or in the best interest of <br />the Owner. <br />1.08 PERMITS <br />A.
