E. If Contractor fails to maintain Site, Engineer will provide Written Notice of Contractor's <br />defective Work. Contractor will be given 24 hours from the Notice to clean Site. After the <br />24-hour period, Owner may correct the defective Work consistent with Article 13.09 of the <br />Conditions of the Contract. <br />3.07 CLEANING AND PROTECTION <br />A. Clean and protect Work in progress and adjoining Work during handling and installation. <br />Apply protective covering on installed Work where it is required to ensure freedom from <br />damage or deterioration. <br />B. Clean and perform maintenance as frequently as necessary throughout construction <br />period. Adjust and lubricate operable components to ensure operability without damage <br />effects. <br />3.08 CUTTING AND PATCHING <br />A. Complete all cutting, fitting, and patching as necessary to join the new Work to existing <br />conditions. <br />B. Remove or cut existing work only as necessary to join the new work to the existing <br />construction or as required by the Contract Documents. <br />C. Patch defective and incomplete surfaces caused or exposed by Work of the Project. <br />D. Repair any damage to existing conditions and patch to match. <br />E. Existing construction designated by the Contract Documents to remain that is loosened, <br />cracked, or otherwise damaged or defaced beyond repair as a result of Work by the <br />Contractor will be considered unsuitable for the use intended and shall be removed and <br />replaced by the Contractor. <br />3.09 SPARE PARTS <br />A. Required spare parts are listed under the individual Specification section. <br />3.10 OUT-OF-STATE CONTRACTOR SURETY DEPOSIT <br />A. When an out-of-state contractor enters into a contract that exceeds $100,000, the <br />Contractor must file Form SD -E, Exemption from Surety Deposits for Out -of -State <br />Contractors, with the Minnesota Department of Revenue. <br />B. If the Contractor is exempt from the surety deposit requirements, he shall provide the City <br />with a copy of the form showing the Revenue Department certification. <br />C. If the Contractor is not exempt, the City will withhold an additional 8 percent of each <br />payment made to the Contractor and forward those funds to the Minnesota Department <br />of Revenue. <br />D.
