b. A subdivision of an area exceeding one acre. This includes subdivision for single-family <br />residential, multi -unit residential, commercial, industrial, or institution development. <br />c. For Public Linear Projects, a permit is required to create or reconstruct 10,000 square feet <br />or more of impervious surface through multiple phases or connected actions of a single project, <br />as defined by the City. <br />d. The site is within the 100 -year floodplain; within 1,000 feet of a public water or protected <br />wetland; impacts a wetland; and/or within 300 feet of Rice Creek, Clearwater Creek, Hardwood <br />Creek, or a public ditch. <br />e. Any land disturbing activity, regardless of size, that the city determines would otherwise <br />cause an adverse impact to an environmentally sensitive area or other property. <br />f. Stormwater Management Requirements do not apply to development of an individual lot <br />within a residential subdivision if it conforms to an approved development plan. <br />g. Stormwater Management Requirements do not apply to sidewalks and trails 10 feet wide <br />or less that are bordered down -gradient by vegetated open space or vegetated filter strip with a <br />minimum width of 5 feet, however the grading, erosion and sediment control requirements are <br />still effective. <br />h. Stormwater Management Requirements do not apply to Mill, Reclamation and Overlay <br />projects that do not expose underlying soils. <br />i. Stormwater Management Requirements do not apply to Bridge Span projects, however <br />grading, erosion and sediment control requirements are still effective. <br />2) Stormwater management performance standards. Site plans for new development of any <br />kind will be assessed for stormwater quantity control and stormwater quality management. The <br />general policy on stormwater runoff rates is to reduce the impacts of development by <br />maintaining predevelopment hydrological conditions in the following ways: <br />a. Use of natural topography. The applicant shall incorporate the use of natural topography <br />and land cover such as natural swales and depressions as they exist before development to the <br />degree that they can accommodate the additional flow of water without compromising the <br />integrity or quality of the receiving waterbody. <br />b. Minimize impact to natural features. The development shall minimize impact to <br />significant natural features. Applicant shall review the site for natural features protected under <br />Lino Lakes, state or federal requirements, including steep slopes, wetlands, wooded areas, <br />endangered or threatened species, or species of concern habitat, areas designated by the county <br />biological survey, greenways, parks and open space, groundwater recharge areas, wellhead or <br />surface water protection areas or regional stormwater pond locations. <br />DRAFT ORD 09-15 CHAPTER 1011STORMWATER & ESC ORDINANCE.DOCX <br />15/29 <br />
