<br />11 <br />LA515\124\964107.v1 <br />the City with an “as built” grading plan and a certification prepared by the Developer’s engineer <br />as required in the City’s Engineering Design and Construction Standards Manual. <br />18. STREET AND UTILITY IMPROVEMENTS. All storm sewers, sanitary sewers, <br />watermain, and streets, including turn lane and intersection improvements, shall be installed in <br />accordance with the approved Plans, the City approvals, the City Code, and the City’s <br />Engineering Design and Construction Standards Manual. Curb and gutter, the first lift of the <br />bituminous streets, sidewalks, boulevards graded, street signs installed, and all restoration work <br />on the site shall be completed in accordance with the approved Plans. Once the work is <br />completed, the Developer or the Developer’s representative shall submit a written request to the <br />City asking for an inspection of the initial improvements. The City will then schedule a walk- <br />through to create a punch list of outstanding items to be fully addressed or corrected by the <br />Developer. Upon receipt of the written punch list provided by the City, the Developer must <br />complete all items on the punch list and then notify the City to re-inspect the Improvements. The <br />Developer shall install the final bituminous wear course after the first bituminous course has <br />weathered a winter season. Prior to placement of the final bituminous wear course, the Developer <br />shall repair or replace all broken or failing curbs, sidewalks and damaged or settled streets as <br />determined by the City from a pre-wear course walk through inspection. <br />19. LANDSCAPING AND TREE REPLACEMENT IMPROVEMENTS. <br />A. The Developer agrees to install landscaping in accordance with the approved Plans, <br />the City approvals, the City Code, the City’s Engineering Design and Construction <br />Standards Manual, and the City’s Landscape and Irrigation Standards. All <br />landscaping materials such as trees, shrubs, grasses, or other vegetation installed <br />by the Developer must be warrantied and maintained for a period of two years. The <br />two-year warranty period for landscaping materials shall be deemed to start once all <br />required landscaping identified as responsibility of Developer in the approved Plans
