I require <br />verification that no mortgages will be recorded against the Property prior to the <br />recording of the Plat. <br /> <br />2. Plat Corrections. I require review of the following revisions. <br /> <br />a. The surveyor’s signature block should be revised to: <br />______________________________ <br />Daniel L, Schmidt, Licensed Land Surveyor <br />Minnesota License No. 26147 <br /> <br />b. The surveyor’s acknowledgment may be revised from “by Daniel L. Schmidt, <br />Licensed Land Surveyor, Minnesota License No. 26147” to “Daniel L. Schmidt.”. <br /> <br />c. The City Planning Commission is not required to sign the plat. The planning <br />commission approval should be removed from the Plat. <br /> <br />3. Title Commitment Exceptions. The Commitment is subject to the following exceptions: <br />a. Terms and conditions of Memorandum of Understanding, filed November 15, <br />2017, as Document No. 4135230. The Memorandum of Understanding <br />memorialized the City’s and a GWSA Land Development, LLC’s understanding <br />that a certain Outlot D of the GWSA subdivision would be credited towards park <br />dedication for that subdivision. No further action is required. <br />b. Terms and conditions of Temporary Construction Easement Agreement, in favor <br />of GWSA Land Development, LLC, as created in document dated June 5, 2018, <br />filed September 17, 2018, as Document No. 4168669. The private, temporary <br />easement, which need not be depicted on the Plat, expires by its terms when the <br />improvements listed on the easement are completed. No further action is required. <br />c. Terms and conditions of Drainage and Utility Easement, in favor of City of Lake <br />Elmo, as created in document filed September 17, 2018, as Document No. 4168670. <br />The easement is depicted on the Plat along the northern perimeters of Lots 10 – 12, <br />Block 5. No further action is required. <br />d. Terms and conditions of Stormwater Management Facility Maintenance <br />Agreement, filed May 15, 2024, as Document No. 443987. The Agreement is <br />between the fee owner in favor of the Valley Branch Watershed District (VBWD). <br />The Agreement required the fee owner to grant the VBWD certain easements for <br />all floodplains and for the lands used for stormwater management facilities. No <br />other action is required. <br />e. Terms and conditions of Development Agreement North Star, filed May 15, 2024, <br />as Document No. 4436989. No further action is required.
