Findings of Fact. <br />To approve the Comprehensive Plan Amendment Request, City staff are proposing the following <br />findings: <br />1. That the applicant has submitted a request in accordance with the procedures as established <br />by the Lake Elmo Planning Department and the Lake Elmo Planning Commission; and <br />2. That the request is to amend the Map 3-3, Future Land Use Map to change the future land <br />use category of the parcel with the PIDs 3302921130028, 3302921420017, and <br />3302921420018, to High Density Residential (HDR); and <br />3. That the proposed amendment is consistent with the overall goals and objectives of the <br />Lake Elmo Comprehensive Plan. <br />4. That the proposed amendment is consistent with the preliminary plat for the Inwood <br />Development granted by the Lake Elmo City Council on December 2, 2014. <br /> <br />To approve the Preliminary Plat and PUD, City staff are proposing the following general findings <br />which are elaborated on in the Draft Resolution approving the Inwood Townhomes Preliminary <br />Plat and PUD: <br />5. The proposed project is consistent with the City’s Comprehensive Plan as amended. <br />6. The proposed project does not meet criteria for denial for Preliminary Plats established by <br />LEC 103.00.090. <br />7. The proposed project is consistent with the minimum criteria and identified objectives for <br />Planned Unit Developments established by LEC 105.12.1130 and LEC 105.12.1150. <br />8. The proposed project will be approved with flexibilities through a PUD but is otherwise <br />consistent with applicable City zoning, land use, design, and engineering standards. <br /> <br />Conditions of Approval. <br />Staff, and the City’s Planning Commission, are recommending an approval conditioned upon the <br />following: <br />1. Prior to the City finding any application for a final plat and final PUD complete, the <br />applicant shall fully address all comments in the following review memos, as may be <br />subsequently revised, to the satisfaction of the City: <br />a. City Engineer’s memo dated May 27, 2025; <br />b. City Landscape Architect’s memo dated May 19, 2025; <br />c. City Fire Chief’s memo dated March 4, 2025; and, <br />2. The Applicant shall make the following revisions to the Preliminary Plat: <br />a. Replace 90-degree parking east of Island Trail with parallel parking, where appropriate, <br />or on street parking where street widths permit. <br />b. Create sidewalk connections on the southeast and southwest corners of the site east of <br />Island Trail to the proposed internal pedestrian network. <br />c. Replace proposed vinyl siding on the attached townhome facades with an approved <br />alternative. <br />d. The traditionally designed private street running between blocks 3 and 5 shall have <br />boulevard tree plantings at least every 50 feet. <br />3. That prior to the City finding any application for final plat and final PUD complete, the <br />applicant shall demonstrate that the plans reflect compliance with South Washington <br />Watershed (SWWD) review requirements and that the applicant provide the City evidence <br />that all conditions attached to a SWWD permit will be met before the starting any grading <br />activity on the site. <br />4. That the applicant shall obtain all necessary permits including but not limited to all <br />applicable City permits (building, grading, sign, etc.), NPDES/SWPPP permits and South
