11. If applicable, a stormwater reuse irrigation and license agreement in a form acceptable to the City shall be <br />executed and recorded with the final plat. <br />12. If applicable, a storm water maintenance and easement agreement in a form acceptable to the City shall be <br />executed and recorded with the final plat. <br />13. Before the execution and recording of a final plat for the development, the developer or applicant shall <br />enter into a Developer’s Agreement or a Site Work Agreement with the City. Such an Agreement must be <br />approved by the City Attorney and by the City Council. The Agreement shall delineate who is responsible for the <br />design, construction and payment for the required improvements with financial guarantees therefore. <br />14. The applicant or developer shall enter into a separate grading agreement with the City before starting any <br />grading activity in advance of final plat/ PUD approval. The City Engineer shall review any grading plan that is <br />submitted in advance of a final plat or final PUD, and said plan shall document the extent of any proposed <br />grading on the site. <br />FISCAL IMPACT: <br />Approval of a Preliminary Plat and Preliminary PUD grant entitlements to a developer. Therefore, there would be <br />no fiscal impact to the City at this time. When the property begins to develop, it will have municipal water service <br />and will pay water connection charges, building permit fees, and the like. <br />PUBLIC HEARING: <br />A public hearing was posted in the Stillwater Gazette on February 27th, 2026, and a notice was mailed to <br />property owners within 500’ of the outermost property boundaries on February 23rd, 2026. It was also added to <br />the City’s Push Notification list on February 23rd, 2026. Below is a summary of the public comments: <br />Mark Citsay (Carriage Station HOA) – Provided comments regarding/requesting trees boarding the <br />Carriage Station property line and proposed species. <br />Nathan Campbell 5380 Linden Trl N (Tamarack Farms Estates HOA) – Provided consolidated HOA <br />written comments in support of the open space design and added considerations for 50th street <br />entrance, traffic, vegetative screening, future trail connections, crosswalks, their development’s private <br />park area, and sewer/water. He also spoke at the hearing reiterating the HOA written comments and <br />traffic/safety concerns. <br />Neil Kreuger (4452 Lake Elmo Ave) – Spoke at the hearing on the scenic beauty of the parcel and family <br />history. He also requested preservation of the Tamarack bog in the area. <br />Danny Hecker (11658 50th St)– Spoke at the hearing in favor of the development but requested <br />additional landscaping/screening around their parcel.
