<br />Payable DCP and State Encumbering and Paying TH Portion
<br />the use, operation, maintenance, repair, and reconstruction of 60th Street North (South Frontage Road)
<br />and all of the facilities constructed as part of this Agreement, without cost or expense to the State.
<br />5.7. Related Signal Agreement. This Agreement will supersede and terminate Agreement No. 85526M, dated
<br />October 28, 2003, between the parties, for the intersection of TH 36 at CSAH 17/Lake Elmo Avenue.
<br />6. Maintenance by the County
<br />Upon completion of the Project, the County will provide the following without cost or expense to the State:
<br />6.1. Roadways. Maintenance of CSAH 17/Lake Elmo Avenue. Maintenance includes, but is not limited to, snow,
<br />ice and debris removal, resurfacing, seal coating, and any other maintenance activities according to
<br />accepted County maintenance practices. The County will maintain the CSAH 17 boulevard, which includes,
<br />but is not limited to, mowing and erosion prevention to maintain grade.
<br />6.2. Storm Sewers. Routine maintenance of storm sewer facilities construction where shown on Exhibit A.
<br />Routine maintenance includes, but is not limited to, removal of sediment, debris, vegetation, and ice from
<br />grates and catch basins, and any other maintenance activities necessary to preserve the facilities and to
<br />prevent conditions such as flooding, erosion, or sedimentation, this also includes informing the District
<br />Maintenance Engineer of any needed repairs.
<br />The County will be responsible for ownership, non-routine maintenance, and routine maintenance of the
<br />storm sewer which crosses under the TH 36 roadway, where shown in Exhibit A.
<br />6.3. Shared Use Path. Maintenance and ownership of the shared use path construction. Maintenance includes,
<br />but is not limited to, snow and ice control/removal, sweeping and debris removal, patching, crack repair,
<br />pavement replacement, vegetation control, signing, pavement markings, and any other maintenance
<br />activities necessary to perpetuate the shared use path in a safe and usable condition.
<br />6.4. Retaining Wall Aesthetics. Maintenance of Retaining Wall No. 3, No. 4, No. 5, No. 6, No. 7, No. 8, No. 9,
<br />and No. 10 construction on CSAH 17 supporting the TH 36 bridges. The County will perform maintenance
<br />and repair of the aesthetic elements (if any) of the retaining walls, including but not limited to, decorative
<br />concrete finishes and any aesthetic elements added to the retaining walls. Aesthetic maintenance and
<br />repair include, but are not limited to, painting, graffiti removal, and any other maintenance activity
<br />necessary to perpetuate the aesthetic elements in an aesthetically acceptable condition.
<br />6.5. Lighting. Maintenance and ownership of lighting facilities construction where shown in Exhibit B.
<br />Maintenance of electrical lighting systems includes everything within the system, from the point of
<br />attachment to the power source or utility, to the last light on the feed point, including but not limited to
<br />re-lamping of lighting units or replacing of LED luminaires, repair or replacement of all damaged luminaire
<br />glassware, loose connections, luminaires when damaged or when ballasts fail, photoelectric control on
<br />luminaires, defective starter boards or drivers, damaged fuse holders, blown fuses, knocked down poles
<br />including wiring within the poles, damaged poles, pull boxes, underground wire, damaged foundations,
<br />equipment pad, installation of approved splices or replacement of wires, repair or extending of conduit,
<br />lighting cabinet maintenance including photoelectric cell, electrical distribution system, Gopher State One
<br />Call (GSOC) locates, and painting of poles and other equipment.
<br />The County will be responsible for the hook up cost and application to secure an adequate power supply
<br />to the service pad or pole and will pay all monthly electrical service expenses necessary to operate the
<br />lighting facilities shown in Exhibit B. The County will pay for the hook up cost and application to secure an
<br />adequate power supply to the State's lighting system on Feed Point T07F.
<br />6.6. Bridge No. 82053 and No. 82054 (TH 36 over CSAH 17/Lake Elmo Avenue). The State will share ownership
<br />responsibilities for Bridge No. 82053 and Bridge No. 82054 with the County. The State will be listed as the
