The State will perform or contract bridge <br />inspections and major bridge maintenance and will invoice the County for 13 percent of the cost of these <br />activities, including administrative costs. The County will be responsible for all CSAH 17/Lake Elmo Avenue <br />major and minor maintenance, except those bridge maintenance items identified below that are the <br />State's responsibility. <br />A. County Responsibilities. The County will keep the CSAH 17/Lake Elmo Avenue roadway reasonably <br />clear from ice and snow and undertake proper and timely cleaning and ice and snow control measures <br />when necessary. The County will be responsible for pavement markings, guardrail on the local <br />roadway, graffiti removal that is visible from the local roadway, and non-structurally supported signing <br />for the roadway under the bridges. The County will be responsible for oversize, overweight and special <br />use permits for the roadway under the bridges. <br />B. State Responsibilities. The State will perform or contract structural inspections and major maintenance <br />of the bridge and invoice the County for the cost of those activities at the cost sharing percentage <br />defined above. Major maintenance includes all structural related maintenance, including expansion <br />joint flushing, deck crack sealing, painting, overlays, re-decking and rehabilitation of the bridge, <br />concrete bridge approach panels, and structurally-supported signing on the bridge. <br />The State is responsible for the following: Maintenance of all guardrails on TH 36. Maintenance of any <br />roadway signing that is attached to the bridge for the purpose of the roadway traffic on TH 36. <br />Maintenance of all non-ornamental fencing on the State’s Right-of-Way. Maintenance of graffiti <br />removal within the control of access below the bridge. The State will determine the safe load rating for <br />the bridge. The State will provide emergency response for traffic hits and restitution from insurance <br />companies or private parties who have damaged the bridge. <br />The State retains its authority to administer, issue, and regulate access permits, sign advertising <br />permits, drainage permits, flag installation, and permits to install utilities on the State’s Right-of-Way. <br />C. Aesthetics. The County will own and perform maintenance and repair of aesthetic elements (if any) on <br />the bridge including, but not limited to, decorative concrete finishes and any aesthetic elements added <br />to the bridge. Maintenance and repair include, but are not limited to, painting, graffiti removal, and any <br />other maintenance activity necessary to perpetuate the aesthetic elements in a safe, usable, and <br />aesthetically acceptable condition. <br />6.7. Additional Drainage. No party to this Agreement will drain any additional drainage volume into the storm <br />sewer facilities constructed under the construction contract that was not included in the drainage for <br />which the storm sewer facilities were designed, without first obtaining written permission to do so from <br />the other party. <br />6.8. Signal System "B". The County will provide for ownership, timing, and maintenance of the Signal System <br />on CSAH17/Lake Elmo Avenue at 60th Street North (North Frontage Road) within trunk highway right of <br />way. Maintenance includes all minor and major signal maintenance in accordance with County accepted <br />practices. <br />6.9. Related Agreements. This Agreement will terminate Agreement No. 85526M, dated October 28, 2003, <br />between the parties, for the intersection of TH 36 at CSAH 17/Lake Elmo Avenue. <br />7. Stormwater Management Facility Maintenance <br />7.1. State Ownership Responsibilities <br />A. The State will be responsible for ownership, routine, and non-routine maintenance of the Shamrock <br />Infiltration Basin, Mouchet Wet Pond, Ziertman Wet Pond, and Kelvin Infiltration Basin stormwater
