A variance is being requested for a reduced setback on the West side of the property to 27 feet. City Code <br />section 105.12.930, Lot Dimensions and Building Bulk Requirements, requires a minimum setback of 150 feet from <br />residential zoning districts. The city setback requirement, the existing wetland, and the current layout of the property <br />significantly restrict potential locations for the building addition. <br />The City Council approved the rezoning of the property to the West (8695 Eagle Point Blvd – Amira Apartments) from <br />Mixed Use Business Park to High Density Residential on November 1st, 2022. The new residential zoning designation of <br />the adjacent property increased the setback requirement on the West side from 30 feet to 150 feet. This planned location preserves the wetland area and landscaping on site. The <br />proposed location also accommodates the existing building, parking lot, and utility layout as well as the access roadway, <br />which serves the adjacent property and cannot be reconfigured or relocated.
