LAKE ELMO CITY COUNCIL MINUTES DECEMBER 1, 2008 3 <br />Consider a wireless telecommunication tower permit and lease agreement to allow AT&T <br />to attach an antenna array to the city water tower and to construct an accessory equipment <br />shelter at 3303 Langley Court North, Resolution no. 2008-055 <br /> <br />Kyle Klatt, Planning Director, reported the City Council was asked to consider a request <br />from AT&T to attach a wireless communications antenna array to the existing city water <br />tower and to construct an accessory equipment shelter at 3303 Langly Court. This is a <br />permitted use but requires a wireless telecommunications tower permit. Annual rent is in <br />the amount of $14,000 prorated for the initial partial year, which shall be increased <br />January 1, 2010 and each January 1, thereafter. <br /> <br />The presentation was abbreviated by the Council since there would be no visual impact <br />on the residents. <br /> <br />MOTION: Council Member DeLapp moved to adopt Resolution no. 2008-055 approving <br />a wireless telecommunications tower permit and lease agreement to allow AT&T to <br />attach a wireless communications antenna array to the existing city water tower and to <br />construct an accessory equipment shelter at 3303 Langly Court North. Council Member <br />Park seconded the motion. The motion passed unanimously. <br /> <br />Consider zoning text amendments to allow a bus/truck terminal as a non-agricultural low <br />impact use in the HD-A-BP zoning district, Ordinance no. 08-010; Resolution no. 2008- <br />056 <br /> <br />Planning Director Kyle Klatt explained the City Council was being asked to consider text <br />amendments to the zoning ordinance to allow a bus/truck terminal as a non-agricultural <br />low impact use in the HD-A-BP district (agriculture holding zone for properties guided <br />for business park development). This request was made by Terry Emerson, 11530 <br />Hudson Boulevard South, concurrent with an application for an interim use permit that <br />could only proceed if the zoning amendment is approved by the Council. <br /> <br />MOTION: Council Member Johnson moved to approve Ordinance no. 08-010 approving <br />a zoning text amendment to allow a bus/truck terminal as a non-agricultural low impact <br />use in the HD-A-BP zoning district based on the reasons cited and on the findings <br />presented. Council Member Park seconded the motion. Mayor Johnston and Council <br />Members Johnson, Park and Smith voted in favor of the motion and Council Member <br />DeLapp voting against. <br /> <br />Consider an interim use permit for a truck terminal within a HD-A-BP zone at 11530 <br />Hudson Blvd., Resolution no. 2008-057 <br /> <br />Planning Director Kyle Klatt explained the City Council was being asked to consider a <br />request for an interim use permit to establish a bus/truck terminal facility as a non- <br />agricultural low impact use at 11530 Hudson Blvd. to replace the vacancy on the site <br />from the legally permitted bus garage that was on the property until July 2008. <br />
