Minutes of the Lake Elmo Village Council August 3, 1971. ContAd. page 2. <br />Counsel Raleigh was asked to investigate the responsibility for trees that are <br />located on a right of way easement that maybe affected by Dutch Elm. <br />Mayor Brockman advised that the Lake Elmo Hardwood Lumber Company has asked about <br />the possibility of purchasing from the Village that area between the tennis courts <br />and Tony Leitte property. After a personal inspection by the Council it was a <br />unanimous decision to retain the property for playground expansion. <br />The Water Study recomended by Bonestroo has been set aside to be reconsidered at <br />the next meeting. Clerk to conduct a survey of water rates in the communities in <br />the immediate area including St. Paul, North St. Paul, Stillwater, Cottage Grove, <br />Woodbury etc. Survey to be completed so information is available at the Aug. 17, <br />1971 meeting. <br />Joe Lenz, Kenridge Addition. Minutes of the Planning Commission read to advise the <br />Council of what had transpired. When the original Plat was made only part of the lots <br />were included but the intent per Mr. Lenz was for the whole area to be developed. <br />Counsel Raleigh was instructed to check the minutes of the Council meeting at the time <br />the plat was made to determine all the factual details and report back at the Aug. 17, <br />1971 meeting. Joe Lenz to be included on the agenda for that meeting at B-00 PM, <br />Joe Lenz also had an interest on an addition to the 'An. Wacker property at the <br />intersection of 3rd & Kalmia. The lot size is not up to current requirements and <br />no addition can be made under such conditions without the approval of the Planning <br />Commission in granting a variance, Joe Lenz was to be added to the Planning Commission <br />agenda for the night of August 10, 1971 to resolve this matter. <br />Elmer Haase -- Read the minutes of the Planning Commission. Village Counsel advised <br />that he was unable to set up the hearing for August 10, 1.971 because the information <br />was incomplete and he had to get additional information from the register of deeds. <br />Hearing would be scheduled for the next Planning Commission meeting. Village Engineer <br />advised that the proposed plat was basically unacceptable. Motion by C. Watson 2nd <br />by 0, Shervheim that the Plat be rejected and Mr. Haase be instructed to have his <br />Surveyor, Mr. Edgar Swenson, get in touch with Otto Bonestroo regarding a more suitable <br />layout considering all the problems. Carried 5-0. <br />Mr. Fratto and Mr. Jim Draok, Attorney for Crossroad Ford asked about action that may <br />be taken regarding Sanitary and Storm sewers through the property in section 32 in the <br />SW corner of Lake Elmo. C. Shervheim presented a Resolution R-71-13 ;regarding ordering <br />a report and hearing on a sanitary & storm sewer in section 32, Village of Lake Elmo, <br />Date September 7, 1971, 9s00 PM. 2nd by C. Watsonp. Carried unanimously. <br />Clerk instructed to schedule as little as possible for the Sept. 7, 1971 meeting, <br />so that the hearing can be held with a minimum of interruption, <br />Planning Commission to be advised of the scheduled hearing. <br />Jim Sehulty asked the Council for permission to split a lot and build. C. Shervheim <br />moved with 2nd by C. Watson that a Variance form be filled out and it be referred to <br />the Planning Commission. Mr. Schultz to be added to Planning Commission agenda for <br />August 10 and scheduled on the Council agenda for August 17. <br />Motion by Mayor Brookman, 2nd by C. Abercrombie that Leo Raleigh be appointed to fill <br />out the unexpired term of Jack Evert on the Planning Commission. Carried 5-0. <br />
