APPROVED AS AMENDED NOVEMBER 21, 2006 <br />Council Member Johnson questioned why the City is limiting seasonal sales to just two <br />zoning districts. She asked why the City is not opening seasonal sales in all residential <br />districts? She observed that it is part of the rural character to permit residents and their <br />children, to.grow products to sell from their property. <br />Council Member DeLapp stated Performance Zoning is relevant to this subject, and <br />should be comprehensive by addressing all zoning districts. If the seasonal sales create a <br />negative impact, it should not be allowed regardless of zoning district. If, however, it <br />does not create a negative impact, it should be allowed regardless of zoning district. <br />Mayor Johnston stated the Council needs to look at the issues of definition, in any case, <br />but we need to fix the immediate problem. If more definition work is needed, the matter <br />can be sent back to the Planning Commission. <br />Attorney Filla stated that zoning is a separate legal matter from definitions. <br />M/S/P Smith/Johnson — to approve Ordinance 97-186, an ordinance relating to definitions <br />contained in the Lake Elmo City Code, amending Farm, Rural definition to read, "The <br />portion of a ten (10) or more acre parcel of land in the Rural Residential Zoning District <br />which is devoted to agriculture by the property owner or by a lessee of the property <br />owner." (Motion passed 5-0) <br />M/S/P Johnson/DeLapp — to direct Staff to work with the Planning Commission <br />investigating options to allow seasonal sales allowed in all residential zones. <br />(Motion passed 5-0) <br />Council discussed an on -site AG and RR signs, and felt that a 45- or 60-day moratorium <br />regarding signs, sizes and color, was appropriate until the Council could review a more <br />comprehensive draft ordinance for adoption. <br />M/S/P DeLapp/Smith — to adopt a Sign Enforcement Moratorium for the next sixty (60) <br />days pending the December 12, 2006, Council Workshop. (Motion passed 5-0) <br />C. Administrative Appeal Hearing: Ziertman — Seasonal Sales in RR Zoning District <br />City Attorney indicated that the Hearings were no longer necessary as the previous <br />actions regarding signs in the AG and RR zones were to be further discussed and <br />presented to the Council for approval at the December 19, 2006, Council meeting. <br />M/S/P Johnson/DeLapp — to take no enforcement action on Items 9C and 9D. <br />(Motion passed 5-0) <br />D. Administrative Appeal Hearing: Bittersweet Farm — Seasonal Sales in RR Zoning <br />District <br />City Attorney indicated that the Hearings were no longer necessary as the previous <br />actions regarding -signs -in the AG and RIB zones -ware to -be -further -discussed -and <br />..................... <br />presented to the Council for approval at the December 19, 2006, Council meeting. <br />LAKE ELMO CITY COUNCIL November 8, 2006 <br />
